To assist and advise the State Commissioner of Health and\n\nthe State Department of Health, there are hereby created:\n\n1. The Consumer Protection Licensing Advisory Council;\n\n2. The Trauma and Emergency Response Advisory Council;\n\n3. The Infant and Children’s Health Advisory Council;\n\n4. The Advancement of Wellness Advisory Council; and\n\n5. The Home Care, Hospice and Palliative Care Advisory Council.\n\nB. 1. Except for the Home Care, Hospice and Palliative Care\n\nAdvisory Council and the Advancement of Wellness Advisory Council,\n\neach Public Health Advisory Council (Advisory Council) created\n\npursuant to subsection A of this section shall consist of seven (7)\n\nmembers. Two members shall be appointed by the Governor, two\n\nmembers shall be appointed by the Speaker of the House of\n\nRepresentatives, two members shall be appointed by the President Pro\n\nTempore of the Senate, and one member shall be appointed by the\n\nCommissioner. Appointments shall be for three-year terms. Members\n\nof the Advisory Councils shall serve at the pleasure of and may be\n\nremoved from office by the appointing authority. Members shall\n\ncontinue to serve until their successors are appointed. Any vacancy\n\nshall be filled in the same manner as the original appointments.\n\nFour members shall constitute a quorum.\n\n2. The Home Care, Hospice and Palliative Care Advisory Council\n\nshall consist of nine (9) members. Two members shall be appointed\n\nby the Governor, three members shall be appointed by the Speaker of\n\nthe House of Representatives, three members shall be appointed by\n\nthe President Pro Tempore of the Senate and one member shall be\n\nappointed by the Commissioner. Five members shall constitute a\n\nquorum.\n\n3. The Advancement of Wellness Advisory Council shall consist\n\nof ten (10) members. Three members shall be appointed by the\n\nGovernor, three members shall be appointed by the President Pro\n\nTempore of the Senate, three members shall be appointed by the\n\nSpeaker of the House of Representatives, and one member shall be\n\nappointed by the Commissioner. Six members shall constitute a\n\nquorum.\n\n4. Each Advisory Council shall meet at least twice a year, but\n\nno more than four times a year and shall elect a chair, a vice\n\nchair, and a secretary from among its members. Each Advisory\n\nCouncil shall only meet as required for election of officers,\n\nestablishment of meeting dates and times; rule development, review,\n\nand recommendation; and adoption of nonbinding resolutions to the\n\nDepartment or the Commissioner concerning matters brought before the\n\nAdvisory Council. Special meetings may be called by the chair or by\n\nthe concurrence of any three members.\n\nC. 1. All members of the Consumer Protection Licensing\n\nAdvisory Council shall be knowledgeable of certain consumer issues\n\nas specified below. The Consumer Protection Licensing Advisory\n\nCouncil shall be composed as follows:\n\na. the Governor shall appoint:\n\n(1) one member who is a licensed radiologist\n\nassistant, and\n\n(2) one member who is a licensed audiologist,\n\nb. the President Pro Tempore of the Senate shall appoint:\n\n(1) one member who is a licensed radiologist, and\n\n(2) one member representing the hearing-aid-fitting\n\nindustry,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member representing the medical\n\nmicropigmentation industry, and\na licensed audiologist,\n\nb. the President Pro Tempore of the Senate shall appoint:\n\n(1) one member who is a licensed radiologist, and\n\n(2) one member representing the hearing-aid-fitting\n\nindustry,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member representing the medical\n\nmicropigmentation industry, and\n\n(2) one member representing the hearing-impaired\n\npublic, and\n\nd. the Commissioner shall appoint one member representing\n\na diagnostic x-ray facility.\n\n2. The jurisdiction areas of the Consumer Protection Licensing\n\nAdvisory Council shall include the hearing-aid-fitting industry, the\n\nmedical micropigmentation industry, the radiation industry, and such\n\nother areas as designated by the Commissioner.\n\nD. 1. All members of the Trauma and Emergency Response\n\nAdvisory Council shall be knowledgeable of issues that arise in a\n\nhospital setting and issues that arise concerning emergency\n\nresponse. The Trauma and Emergency Response Advisory Council shall\n\nbe composed as follows:\n\na. the Governor shall appoint:\n\n(1) one member who is an administrative director of a\n\nlicensed ambulance service, and\n\n(2) one member who is a board-certified emergency\n\nphysician,\n\nb. the President Pro Tempore of the Senate shall appoint:\n\n(1) one member who is a representative from a\n\nhospital with trauma and emergency services, and\n\n(2) one member who is a trauma surgeon with\n\nprivileges at a hospital with trauma and\n\nemergency operative services,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member representing the trauma registrar of a\n\nlicensed hospital that is classified as providing\n\ntrauma and emergency operative services, and\n\n(2) one member who is an emergency medical\n\ntechnician, and\n\nd. the Commissioner shall appoint one member who is a\n\ncritical care nurse.\n\n2. The jurisdictional areas of the Trauma and Emergency\n\nResponse Advisory Council shall include emergency response systems\n\ndevelopment, injury prevention, catastrophic health emergency,\n\ntrauma systems improvement and development and such other areas\n\ndesignated by the Commissioner.\n\nE. 1. All members of the Infant and Children’s Health Advisory\n\nCouncil shall be knowledgeable of issues that arise in the area of\n\ninfant and children’s health care. The Infant and Children’s Health\n\nAdvisory Council shall be composed as follows:\n\na. the Governor shall appoint:\n\n(1) one member who works for the state or for a\n\npolitical subdivision on child abuse issues, and\n\n(2) one member who is knowledgeable about childhood\n\nimmunizations,\n\nb. the President Pro Tempore of the Senate shall appoint:\n\n(1) one member who is knowledgeable about newborn\n\nscreening issues,\n\n(2) one member licensed by the state as an\n\noptometrist who has knowledge of vision screening\n\nfor children, and\n\n(3) one member who is a licensed ophthalmologist in\n\nthis state with the knowledge of treating visual\n\ndeficiencies in children,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member who is licensed by the state as a\n\nphysician and works as a pediatrician, and\n\n(2) one member who is licensed by the state as a\n\ngenetic counselor, and\n\nd. the Commissioner shall appoint one member who is a\n\nphysician licensed by the state who specializes in the\n\ndiagnosis and treatment of childhood injuries in a\n\ntrauma setting.\n\n2. The jurisdictional areas of the Infant and Children’s Health\n\nAdvisory Council shall include all issues that arise in the area of\n\nhealth care for infants and children and such other areas as\n\ndesignated by the Commissioner.\n\nF. 1. All members of the Advancement of Wellness Advisory\n\nCouncil shall be knowledgeable of issues that arise in the area of\n\nadvancing the health of all Oklahomans. The Advancement of Wellness\n\nAdvisory Council shall be composed as follows:\n\na. the Governor shall appoint:\nues that arise in the area of\n\nhealth care for infants and children and such other areas as\n\ndesignated by the Commissioner.\n\nF. 1. All members of the Advancement of Wellness Advisory\n\nCouncil shall be knowledgeable of issues that arise in the area of\n\nadvancing the health of all Oklahomans. The Advancement of Wellness\n\nAdvisory Council shall be composed as follows:\n\na. the Governor shall appoint:\n\n(1) one member who is knowledgeable about breast and\n\ncervical cancer issues,\n\n(2) one member who is knowledgeable about organ donor\n\nissues, and\n\n(3) one member who is knowledgeable about\n\ncardiometabolic disease including obesity,\n\ndyslipidemia, hypertension, and diabetes,\n\nb. the President Pro Tempore of the Senate shall appoint:\n\n(1) one member who is mayor of a city or town that\n\nhas been designated a certified healthy community\n\nin an urban setting,\n\n(2) one member who is the president or chief\n\noperating officer of a business that has been\n\ndesignated a certified healthy business, and\n\n(3) one member who represents an Urban Indian Health\n\nCenter in this state or a nonprofit organization\n\nwith a major focus on improving public health for\n\ncitizens of federally recognized tribes in this\n\nstate,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member who is the mayor of a city or town\n\nthat has been designated a certified healthy\n\ncommunity in a rural setting,\n\n(2) one member who is the president or chief\n\noperating officer of a business that has been\n\ndesignated a certified healthy business in an\n\nurban setting, and\n\n(3) one member who represents a federally recognized\n\ntribe based in this state which maintains a\n\ntribally operated health system, and\n\nd. the Commissioner shall appoint one member who is the\n\nExecutive Director of the Tobacco Settlement Endowment\n\nTrust.\n\n2. The jurisdictional areas of the Advancement of Wellness\n\nAdvisory Council shall include all issues that arise in the areas of\n\ntobacco usage and cessation, organ and tissue donation,\n\ncardiometabolic disease, American Indian health, the requirements\n\nfor a city or town in the state to be designated as a certified\n\nhealthy community, the requirements for a business to be designated\n\nas a certified healthy business and such other areas as designated\n\nby the Commissioner.\n\nG. 1. All members of the Home Care, Hospice and Palliative\n\nCare Advisory Council shall be knowledgeable of issues that arise in\n\nthe administration and practice of home care, hospice and palliative\n\ncare services. The Home Care, Hospice and Palliative Care Advisory\n\nCouncil shall be composed as follows:\n\na. the Governor shall appoint:\n\n(1) one member who is the owner or administrator of\n\nan entity licensed in accordance with the\n\nOklahoma Hospice Licensing Act, and\n\n(2) one member who is an owner or administrator of an\n\nentity licensed in accordance with the Home Care\n\nAct,\n\nb. the President Pro Tempore of the Senate shall appoint:\n\n(1) one member who is an owner or administrator of an\n\nentity licensed in accordance with the Oklahoma\n\nHospice Licensing Act,\n\n(2) one member who is an owner or administrator of an\n\nentity licensed in accordance with the Home Care\n\nAct, and\n\n(3) one member who is a member of the palliative care\n\npatient advocacy community,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member representing the public who is or was\n\na legal guardian of a recipient of hospice\n\nservices,\n\n(2) one member representing the public who is a\n\nrecipient or legal guardian of a recipient of\n\nservices from a home health agency, and\nt, and\n\n(3) one member who is a member of the palliative care\n\npatient advocacy community,\n\nc. the Speaker of the House of Representatives shall\n\nappoint:\n\n(1) one member representing the public who is or was\n\na legal guardian of a recipient of hospice\n\nservices,\n\n(2) one member representing the public who is a\n\nrecipient or legal guardian of a recipient of\n\nservices from a home health agency, and\n\n(3) one member who is an allopathic or osteopathic\n\nphysician or nurse certified in palliative care\n\ndelivery in this state, and\n\nd. the Commissioner shall appoint one member representing\n\nan association which advocates on behalf of home care\n\nor hospice issues.\n\n2. The jurisdictional areas of the Home Care, Hospice and\n\nPalliative Care Advisory Council shall include all issues that arise\n\nin the areas of home care, hospice services and palliative care,\n\nincluding, but not limited to:\n\na. identifying methods that improve the quality and\n\ndelivery of home care, hospice and palliative care,\n\nb. reviewing best practices from home care, hospice and\n\npalliative care programs in the state,\n\nc. developing information on home care, hospice and\n\npalliative care issues for the general public, and\n\nd. such other areas as designated by the Commissioner.\n\nH. In addition to other powers and duties assigned to each\n\nAdvisory Council pursuant to this section, each Advisory Council,\n\nwithin its jurisdictional area, shall:\n\n1. Have authority to recommend to the Commissioner rules on\n\nbehalf of the Department. The Department shall not have standing to\n\nrecommend to the Commissioner permanent rules or changes to such\n\nrules within the jurisdiction of an Advisory Council which have not\n\nbeen submitted previously to the appropriate Advisory Council for\n\naction;\n\n2. Before recommending any permanent rules to the Commissioner,\n\ngive public notice, offer an opportunity for public comment and\n\nconduct a public rulemaking hearing when required by the\n\nAdministrative Procedures Act;\n\n3. Have the authority to make nonbinding written\n\nrecommendations to the Commissioner or to the Department which have\n\nbeen concurred upon by at least a majority of the membership of the\n\nAdvisory Council;\n\n4. Have the authority to provide a public forum for the\n\ndiscussion of issues it considers relevant to its area of\n\njurisdiction, and to:\n\na. pass nonbinding resolutions expressing the sense of\n\nthe Advisory Council, and\n\nb. make recommendations to the Commissioner or the\n\nDepartment concerning the need and the desirability of\n\nconducting meetings, workshops, and seminars; and\n\n5. Cooperate with each other Advisory Council, the public, the\n\nCommissioner, and the Commissioner of Health in order to coordinate\n\nthe rules within their respective jurisdictional areas and to\n\nachieve maximum efficiency and effectiveness in furthering the\n\nobjectives of the Department.\n\nI. The Advisory Councils shall not recommend rules for\n\npromulgation by the Commissioner unless all applicable requirements\n\nof the Administrative Procedures Act have been followed, including\n\nbut not limited to notice, rule-impact statement, and rulemaking\n\nhearings.\n\nJ. Members of the Advisory Councils shall serve without\n\ncompensation.
