The State Department of Health shall:\n\n1. Ensure that no employee of the Department whose\n\nresponsibilities relate in any manner to long-term care is subject\n\nto a conflict of interest which would impair the ability of the\n\nperson to carry out his or her employment duties in an impartial\n\nmanner including, but not limited to:\n\na. ownership or investment interest by the employee or a\n\nmember of the employee’s immediate family represented\n\nby equity, debt or other financial relationship in a\n\nlong-term care facility or a long-term care service,\n\nb. employment by, under contract to, or participation by\n\nthe employee or a member of the employee’s immediate\n\nfamily in the management of, a long-term care\n\nfacility, except as provided in Section 1-1914.2 of\n\nTitle 63 of the Oklahoma Statutes and with the\n\napproval of the State Commissioner of Health, or\n\nc. the receipt or the right of the employee or a member\n\nof the employee’s immediate family to receive directly\n\nor indirectly remuneration, in cash or in kind, under\n\na compensation arrangement with an owner or operator\n\nof a long-term care facility; and\n\n2. Establish and specify, in writing, mechanisms to identify\n\nand remove conflicts of interest referred to in this section\n\nincluding, but not limited to:\n\na. the methods by which the Department will examine\n\nindividuals and members of the individuals' immediate\n\nfamily members to identify the conflicts, and\n\nb. the actions that the Department will require the\n\nindividuals and such family members to take to\n\neliminate such conflicts.\n\nB. For purposes of this section, the term “immediate family”\n\nmeans:\n\n1. The spouse of the employee;\n\n2. The parents of the spouse of the employee;\n\n3. A child by birth or adoption;\n\n4. A stepchild;\n\n5. A parent;\n\n6. A grandparent;\n\n7. A grandchild;\n\n8. A sibling of the employee;\n\n9. The spouse of any immediate family member specified in this\n\nsubsection; or\n\n10.
