The Office of Accountability Systems of the State Department\n\nof Health (OAS) shall have the authority to:\n\n1. Coordinate audits and investigations and make reports to the\n\nState Board of Health and State Commissioner of Health within the\n\nState Department of Health and State Health Officer relating to the\n\nadministration of programs and operations of the State Department of\n\nHealth;\n\n2. Except as otherwise prohibited by current law, access all\n\nrecords, reports, audits, reviews, documents, papers,\n\nrecommendations, or other material which relate to programs and\n\noperations with respect to which the Director of the Office of\n\nAccountability Systems has responsibilities;\n\n3. Request assistance from other state, federal and local\n\ngovernment agencies;\n\n4. Issue administrative subpoenas for the production of all\n\ninformation, documents, reports, answers, records, accounts, papers,\n\nand other data and documentary evidence;\n\n5. Administer to or take from any current or former employee of\n\nthe State Department of Health an oath, affirmation, or affidavit;\n\n6. Receive and investigate complaints or information from an\n\nemployee of the Department, service recipient or member of the\n\npublic concerning the possible existence of an activity within the\n\nState Department of Health constituting a violation of law, rules or\n\nregulations, mismanagement, gross waste of funds, abuse of authority\n\nor a substantial and specific danger to the public health and\n\nsafety;\n\n7. Cause to be issued on behalf of OAS credentials, including\n\nan identification card with the State Seal; and\n\n8. Keep confidential all actions and records relating to OAS\n\ncomplaints.\n\nB. It shall be the duty and responsibility of the Director and\n\nstaff of the Office of Accountability Systems to:\n\n1. Keep the State Board of Health and the State Commissioner of\n\nHealth fully informed of matters relating to fraud, abuses,\n\ndeficiencies and other serious problems of which the Director is\n\naware relating to the administration of programs and operations\n\nwithin the State Department of Health. Further, the Director shall\n\nrecommend corrective action concerning such matters and report to\n\nthe State Board of Health and the State Commissioner of Health on\n\nthe progress of the corrective matters, except when such matters\n\nrelate to the State Commissioner of Health or the performance of his\n\nor her duties in such capacity. Matters directly involving the\n\nCommissioner may be reported by the Director to the Board without\n\nproviding notice to the Commissioner;\n\n2. Report to and be under the direct supervision of the State\n\nBoard of Health and shall not be subject to supervision or report to\n\nany other State Department of Health employee. Unless otherwise\n\ninstructed by the State Board of Health, staff of the Office of\n\nAccountability Systems and independent contractors performing\n\ninternal investigative services for the Office of Accountability\n\nSystems shall be directly supervised by the Director of the Office\n\nof Accountability Systems and not subject to the supervision of or\n\nrequired to report to any other State Department of Health employee.\n\nNeither the State Commissioner of Health nor any other employee of\n\nthe State Department of Health shall prevent, prohibit, or obstruct\n\nthe Director from initiating, implementing or completing any\n\ninvestigation or from issuing any subpoena during the course of an\n\ninvestigation or audit regarding the State Department of Health; and\n\n3.
