Stat. tit. 63, § 63-1-106.1","heading":"Fee schedule for licenses, permits and other health","body":"services.\n\nA. The State Board of Health may establish a system of fees to\n\nbe charged for health services and for services rendered to members\n\nof the public in the issuance and renewal of licenses and permits by\n\nthe State Commissioner of Health and the State Department of Health.\n\nThis provision is subject to the following limitations:\n\n1. No schedule of fees may be established or amended by the\n\nBoard except during such times as the Legislature is in session;\n\nprovided, the Board may establish or amend a schedule of fees at a\n\ntime when the Legislature is not in session if the fees or schedule\n\nof fees has been specifically authorized by the Legislature or has\n\nbeen approved by the Contingency Review Board. The State Board of\n\nHealth must follow the procedures required by Article I of the\n\nAdministrative Procedures Act for adoption of rules and regulations\n\nin establishing or amending any such schedule of fees; and\n\n2. The Board shall charge fees only within the following\n\nranges, except as may be otherwise provided for in this title.\n\nFor license or permit issuance: $50.00 to $2,000.00\n\nFor license or permit renewal: $10.00 to $500.00\n\nFor health services: $25.00 to $250.00\n\nprovided further, that any facility exempt from the requirement to\n\nobtain a permit based on date of construction or start-up may be\n\nassessed an annual permit renewal fee equivalent.\n\nB. The Board's authority to establish such a fee schedule shall\n\nextend to all programs administered by the State Commissioner of\n\nHealth and the State Department of Health, regardless of whether the\n\nstatutes creating such programs are codified in the Oklahoma Public\n\nHealth Code.\n\nC. The Board shall base its schedule of licensing or permitting\n\nfees upon the reasonable costs of review and inspection services\n\nrendered in connection with each license and permit program, but\n\nshall be within the ranges specified in subsection A of this\n\nsection, except as may be otherwise specified in this section. The\n\nDepartment shall establish a system of training for all personnel\n\nwho render review and inspection services in order to assure uniform\n\nstatewide application of rules and regulations and the Board shall\n\nalso base the fee on reasonable costs associated with the training\n\nof those personnel. Such fees shall not be used in the operation of\n\nlocal health departments whose personnel do not participate fully in\n\napplicable State Department of Health training and standardization\n\nprograms.\n\nD. The Board may exempt by rule any class of licensee or\n\npermittee or any class of facility or activity to be licensed or\n\npermitted from the requirements of the fee schedule if the Board\n\ndetermines that the creation of such a schedule for any such class\n\nwould work an unreasonable economic hardship.\n\nE. All statutory fees now in effect for health services and for\n\nthe issuance and renewal of any license or permit administered by\n\nthe State Commissioner of Health and the State Department of Health\n\nwithin the jurisdiction of the Department shall remain in effect\n\nuntil such time as the Board acts to implement new fee schedules\n\npursuant to the provisions of this Code.\n\nF.
