There is hereby created within the State Department of\n\nHealth the Oklahoma Food Service Advisory Council. The purpose of\n\nthe Advisory Council shall be to:\n\n1. Advise the State Board of Health, the State Commissioner of\n\nHealth, and the Department regarding food service establishments;\n\nand\n\n2. Recommend actions to improve sanitation and consumer\n\nprotection.\n\nB. The Advisory Council shall have the duty and authority to:\n\n1. Review and approve in an advisory capacity only rules and\n\nstandards for food service establishments operating in this state;\n\n2. Evaluate, review and make recommendations regarding\n\nDepartment inspection activities; and\n\n3. Recommend and approve quality indicators and data submission\n\nrequirements for food service establishments which shall be used by\n\nthe Department to monitor compliance with licensure requirements and\n\nto publish an annual report of food service establishment\n\nperformance.\n\nC. The Oklahoma Food Service Advisory Council shall be composed\n\nof fourteen (14) members as follows:\n\n1. Nine members shall be appointed by the Commissioner, with the\n\nadvice and consent of the Board, from a list of three names for each\n\nposition provided by an association representing the majority of\n\nrestaurant owners in this state. Such appointments shall be as\n\nfollows:\n\na. one member shall represent the Oklahoma Restaurant\n\nAssociation,\n\nb. one member shall represent the Oklahoma Hotel and\n\nMotel Association,\n\nc. one member shall represent the Oklahoma Grocers\n\nAssociation,\n\nd. one member shall represent food service education,\n\ne. one member shall represent food processing education,\n\nf. one member shall be an independent food service\n\noperator,\n\ng. one member shall be a food processor,\n\nh. one member shall represent the School Nutrition\n\nAssociation of Oklahoma, and\n\ni. one member shall be a citizen representing the public\n\nand shall not be a food service establishment operator\n\nor employee and shall not be a member of a food\n\nservice governing board; and\n\n2. The remaining appointments shall consist of:\n\na. the Director of the Oklahoma City-County Health\n\nDepartment, or a designee,\n\nb. the Director of the Tulsa City-County Health\n\nDepartment, or a designee,\n\nc. two directors from other county health departments in\n\nthis state or designees, appointed by the\n\nCommissioner, and\n\nd. the Director of the Oklahoma Department of\n\nAgriculture, Food, and Forestry or a designee.\n\nD. The appointments made by the Commissioner shall be for three-\n\nyear terms, except that after the effective date of this act, the\n\ninitial term of the representative of the public shall be for one\n\n(1) year, and the initial terms of the independent food service\n\noperator, the food processor, the representatives of food service\n\neducation, and food processing education shall be for two (2) years.\n\nThe initial terms of all other members appointed by the Commissioner\n\nshall be for three (3) years. After initial appointments to the\n\nAdvisory Council, the Commissioner shall appoint members to three-\n\nyear terms.\n\nE.
