Stat. tit. 63, § 63-1-107.4","heading":"Oklahoma Department of Health Civil Monetary Penalty","body":"Revolving Fund.\n\nA. There is hereby created in the State Treasury a fund for the\n\nState Department of Health to be designated the \"Oklahoma Department\n\nof Health Civil Monetary Penalty Revolving Fund\". The fund shall be\n\na continuing fund, not subject to fiscal year limitations. It shall\n\nconsist of monies received by the State Department of Health which\n\nemanate from fines and assessments against Oklahoma nursing homes\n\nand other long-term and non-long-term care facilities found to be\n\nnoncompliant with federal conditions of participation.\n\nB. All monies accruing to the credit of the fund are hereby\n\nappropriated and may be budgeted and expended by the State\n\nDepartment of Health at the discretion of the Commissioner of Health\n\nfor the protection of the health or property of residents of nursing\n\nfacilities.\n\nC. All expenditures shall be in compliance with requirements of\n\nthe Centers for Medicare and Medicaid Services. Expenditures from\n\nthe fund shall be made upon warrants issued by the State Treasurer\n\nagainst claims filed as prescribed by law with the Director of the\n\nOffice of Management and Enterprise Services for approval and\n\npayment.\n\nD.
