The term \"food\" means:\n\na. articles used for food or drink for human consumption,\n\nb. chewing gum, and\n\nc. articles used for components of any such article.\n\n2. The term \"label\" means a display of written, printed or\n\ngraphic matter upon the immediate container of any article; and a\n\nrequirement made by or under authority of this article that any\n\nword, statement, or other information appearing on the label shall\n\nnot be considered to be complied with unless such word, statement,\n\nor other information also appears on the outside container or\n\nwrapper, if there be any, of the retail package of such article, or\n\nis easily legible through the outside container or wrapper.\n\n3. The term \"immediate container\" does not include package\n\nliners.\n\n4. The term \"labeling\" means all labels and other written,\n\nprinted or graphic matter:\n\na. upon an article or any of its containers or wrappers,\n\nor\n\nb. accompanying such article.\n\n5. If an article is alleged to be misbranded because the\n\nlabeling is misleading, or if an advertisement is alleged to be\n\nfalse because it is misleading, then in determining whether the\n\nlabeling or advertisement is misleading there shall be taken into\n\naccount (among other things) not only representations made or\n\nsuggested by statement, word, design, device, sound, or in any\n\ncombination thereof, but also the extent to which the labeling or\n\nadvertisement fails to reveal facts material in the light of such\n\nrepresentations or material with respect to consequences which may\n\nresult from the use of the article to which the labeling or\n\nadvertisement relates, under the conditions of use prescribed in the\n\nlabeling or advertisement thereof, or under such conditions of use\n\nas are customary or usual.\n\n6. The term \"advertisement\" means all representations\n\ndisseminated in any manner or by any means, other than by labeling,\n\nfor the purpose of inducing, or which are likely to induce, directly\n\nor indirectly, the purchase of food.\n\n7. The term \"contaminated with filth\" applies to any food not\n\nsecurely protected from dust, dirt, and, as far as may be necessary\n\nby all reasonable means, from all foreign or injurious\n\ncontaminations.\n\n8. The provisions of this article regarding the selling of food\n\nshall be considered to include the manufacture, production,\n\nprocessing, packing, exposure, offer, possession, and holding of any\n\nsuch article for sale; and the sale, dispensing, and giving of any\n\nsuch article, and the supplying or applying of any such articles in\n\nthe conduct of any food establishment.\n\n9. The term \"Federal Act\" means the Federal Food, Drug, and\n\nCosmetic Act.\n\n10. The term \"mobile food establishment\" means a facility\n\nincluding a trailer, that prepares food and beverages, is vehicle\n\nmounted, is road-approved by the Department of Transportation\n\nincluding wheels and axles, is readily movable, and remains at one\n\nphysical address for no more than twelve (12) hours at one time,\n\nunless the mobile food establishment is operating on private\n\nproperty. A mobile food establishment operating on private property\n\nmay remain at one physical address for no more than fourteen (14)\n\ndays.\n\n11. The term \"mobile push cart\" means a non-self-propelled food\n\nunit that can be manually moved by an average person without being\n\nvehicle mounted.\n\n12. The term \"mobile retail food establishment\" means a\n\nlicensed enterprise which sells packaged foods from a stationary\n\ndisplay at a location some distance from the establishment but still\n\nat the same physical address for no more than twelve (12) hours;\n\nprovided, the licensed unit is on the premises and readily available\n\nfor inspection and the food has been prepared in a facility that is\n\nregulated by the good manufacturing practices in Title 21 of the\nlay at a location some distance from the establishment but still\n\nat the same physical address for no more than twelve (12) hours;\n\nprovided, the licensed unit is on the premises and readily available\n\nfor inspection and the food has been prepared in a facility that is\n\nregulated by the good manufacturing practices in Title 21 of the\n\nCode of Federal Regulations or pursuant to Section 310:260 of the\n\nOklahoma Administrative Code, Good Manufacturing Practice\n\nRegulations, Oklahoma Department of Agriculture, Food, and Forestry,\n\nand United States Department of Agriculture, or this act.\n\n13. The term \"mobile food vendor\" means any person who\n\ndispenses food or beverages from a mobile food establishment, mobile\n\npush cart, or mobile retail food establishment.\n\n14. The term \"mobile food vending\" means dispensing food or\n\nbeverages from a food vending vehicle.\n\n15. The term \"food vending vehicle\" means a mobile food\n\nestablishment, mobile push cart, or mobile retail food\n\nestablishment.\n\n16. The term \"local authority\" means any local government\n\nincluding any town, city, charter city, political subdivision, or\n\ncounty.\n\n17. The term \"public property\" means any property owned and\n\noperated by this state or a local authority for the benefit of the\n\npublic and includes all rights-of-way contained wholly within any\n\nstate or local authority parks.\n\n18. The term \"temporary mass gathering\" means an actual or\n\nreasonably anticipated assembly of three hundred (300) or more\n\npeople for an event that continues, or reasonably can be expected to\n\ncontinue, for two (2) or more hours per day.\n\n19.
