Stat. tit. 63, § 63-1-1104","heading":"Violations - Punishment","body":"(a) Any person who violates any of the provisions of Section\n\n1102 of this article shall be guilty of a misdemeanor, and shall on\n\nconviction thereof be subject to imprisonment for not more than\n\nthirty (30) days, or a fine of not more than One Hundred Dollars\n\n($100.00), or both such imprisonment and fine; but if the violation\n\nis committed after a conviction of such person under this section\n\nhas become final, such person shall be subject to imprisonment for\n\nnot more than six (6) months, or a fine of not more than Five\n\nHundred Dollars ($500.00), or both such imprisonment and fine.\n\n(b) No person shall be subject to the penalties of subsection\n\n(a) of this section for having violated Section 1102(a) or (c) of\n\nthis article if he establishes a guaranty or undertaking signed by,\n\nand containing the name and address of, the person residing in the\n\nUnited States from whom he received in good faith the article, to\n\nthe effect that such article is not adulterated or misbranded within\n\nthe meaning of this article, designating this article.\n\n(c) No publisher, radiobroadcast or television licensee, or\n\nagency or medium for the dissemination of an advertisement, except\n\nthe manufacturer, packer, distributor, or seller of the article to\n\nwhich a false advertisement relates, shall be liable under this\n\nsection by reason of the dissemination by him of such false\n\nadvertisement, unless he has refused on the request of the State\n\nCommissioner of Health or his duly-authorized agent to furnish the\n\nCommissioner the name and post office address of the manufacturer,\n\npacker, distributor, seller, or advertising agency residing in the\n\nUnited States who caused him to disseminate such advertisement.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5baa857e793d9a1256daaa3e018ae30bf98b1f8e9a1d6ba9a5dcec5b1c32c9f2","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1103","next":"us-ok/okla.-stat.-tit.-63-63-1-1105"},"notice":"GroundRules: Original legal text.
