Stat. tit. 63, § 63-1-1109","heading":"Adulterated food","body":"A food shall be deemed to be adulterated:\n\n(a) (1) if it bears or contains any poisonous or deleterious\n\nsubstance which may render it injurious to health; but in case the\n\nsubstance is not an added substance, such food shall not be\n\nconsidered adulterated under this clause if the quantity of such\n\nsubstance in such food does not ordinarily render it injurious to\n\nhealth; or (2) if it bears or contains any added poisonous or added\n\ndeleterious substance which is unsafe within the meaning of Section\n\n1112 of this article; or (3) if it consists in whole or in part of a\n\ndiseased, contaminated, filthy, putrid, or decomposed substance, or\n\nif it is otherwise unfit for food; or (4) if it has been produced,\n\nprepared, packed, or held under insanitary conditions whereby it may\n\nhave been rendered diseased, unwholesome, or injurious to health; or\n\n(5) if it is the product of a diseased animal or an animal which has\n\ndied otherwise than by slaughter, or that has been fed upon the\n\nuncooked offal from a slaughterhouse; or (6) if its container is\n\ncomposed, in whole or in part, of any poisonous or deleterious\n\nsubstance which may render the contents injurious to health.\n\n(b) (1) if any valuable constituent has been in whole or in part\n\nomitted or abstracted therefrom; or (2) if any substance has been\n\nsubstituted wholly or in part therefor; or (3) if damage or\n\ninferiority has been concealed in any manner; or (4) if any\n\nsubstance has been added thereto or mixed or packed therewith so as\n\nto increase its bulk or weight, or reduce its quality or strength or\n\nmake it appear better or of greater value than it is.\n\n(c) if it is confectionery and it bears or contains any alcohol\n\nor nonnutritive article of substance except harmless coloring,\n\nharmless flavoring, harmless resinous glaze not in excess of four-\n\ntenths of one percent (4/10 of 1%), harmless natural wax not in\n\nexcess of four-tenths of one percent (4/10 of 1%), harmless natural\n\ngum and pectin; provided, that this paragraph shall not apply to any\n\nconfectionery by reason of its containing less than one-half of one\n\npercent (1/2 of 1%) of volume of alcohol derived solely from the use\n\nof flavoring extracts, or to any chewing gum by reason of its\n\ncontaining harmless nonnutritive masticatory substances.\n\n(d) if it bears or contains a coal tar color other than one from\n\na batch which has been certified under authority of the Federal Act.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a33b4452006e63ad34cd66c84983bb4807dcd9471d16e7de3ba42f83d85f96ac","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1108","next":"us-ok/okla.-stat.-tit.-63-63-1-1110"},"notice":"GroundRules: Original legal text.
