Stat. tit. 63, § 63-1-1150","heading":"Authority to operate – Permissible locations –","body":"Promulgation of rules.\n\nA. A mobile food vendor with a food establishment license\n\nrequired under Section 1-1118 of Title 63 of the Oklahoma Statutes\n\nis authorized to operate in this state subject to this section.\n\nMobile food vendors shall follow all state and local laws and\n\nregulations governing operations in the jurisdiction where the\n\nvendor is operating that are not in conflict with this act.\n\nB. A mobile food vendor with a food establishment license\n\nrequired under Section 1-1118 of Title 63 of the Oklahoma Statutes\n\nshall provide a copy of its state license to a local authority for\n\nrecognition by the local authority before operating in the local\n\nauthority's jurisdiction. The local authority shall recognize a\n\nlawful and valid state license and authorize the mobile food vendor\n\nto operate in its jurisdiction within five (5) business days of\n\nreceipt of the state license and verification of compliance with\n\nlocal regulations not in conflict with this act. Such recognition\n\nand authorization may include issuing a local license or permit to\n\nthe mobile food vendor. Any local license or permit issued shall\n\nnot impose additional requirements that conflict with this act.\n\nC. Upon compliance with subsection B of this section, a mobile\n\nfood vendor may operate in the following locations:\n\n1. Any location allowed by the local authority; and\n\n2. On private property under the following circumstances:\n\na. the property is located in a zoning district where\n\nfood service establishments are permitted to operate\n\nand the vendor has permission of the property owner,\n\ndesignee, or lessor,\n\nb. the property is located in a residential zoning\n\ndistrict and the mobile food vendor has been invited\n\nby a resident or group of residents in that district\n\nto operate on their property for the purpose of\n\nserving food to that resident, group of residents, or\n\ntheir guests; provided, that the operation of mobile\n\nfood vendors on the subject property not exceed twelve\n\n(12) days per year, and\n\nc. the mobile food vendor would not cause a nuisance.\n\nD. A mobile food vendor shall not operate in any manner which\n\nwill interfere with or obstruct the free passage of pedestrians or\n\nvehicles along any street, sidewalk, or parkway.\n\nE. A mobile food vendor shall not operate in a state park\n\nwithout having a contract or lease agreement approved by the\n\nOklahoma Tourism and Recreation Commission.\n\nF. When operating, a mobile food vendor shall:\n\n1. Maintain a food vending vehicle in good operating order;\n\n2. Provide a waste receptacle for customers that is visible and\n\nrequest that customers use it;\n\n3. Remove and dispose of all refuse within a twenty-five-foot\n\nradius of the mobile food vendor's operating area at the conclusion\n\nof operation;\n\n4. Display the mobile food vendor's food establishment license\n\nin a conspicuous location for public view; and\n\n5. If serving food at a temporary mass gathering, notify the\n\nState Department of Health and the local authority in the\n\njurisdiction where the gathering is to be located of the dates the\n\nmobile food vendor will operate at the temporary mass gathering at\n\nleast ten (10) business days prior to the gathering.\n\nG. The State Commissioner of Health may promulgate rules to\n\nenforce the provisions of this section. Rules adopted shall not:\n\n1. Require a mobile food vendor to operate a specific distance\n\nfrom the perimeter of an existing commercial establishment or to\n\nenter into any agreement with a commercial establishment;\n\n2. Require a mobile food vendor that serves only prepackaged\n\nfood or that does not prepare or open food to have a handwashing\n\nsink in the food vending vehicle;\n\n3. Require a mobile food vendor to associate with a commissary\n\nif the vendor carries all the equipment necessary to comply with\n\nhealth and safety standards and applicable regulations;\n\n4. Limit the number of licensed mobile food vendors;\nRequire a mobile food vendor that serves only prepackaged\n\nfood or that does not prepare or open food to have a handwashing\n\nsink in the food vending vehicle;\n\n3. Require a mobile food vendor to associate with a commissary\n\nif the vendor carries all the equipment necessary to comply with\n\nhealth and safety standards and applicable regulations;\n\n4. Limit the number of licensed mobile food vendors;\n\n5. Require a mobile food vendor to obtain any additional\n\npermits from a local authority unless the mobile food vendor seeks\n\nto operate at an event which is permitted by a local authority or in\n\na local, public park;\n\n6. Require a mobile food vendor to be fingerprinted or to\n\ninstall a Global Positioning System (GPS) tracking device on the\n\nvendor's vehicle;\n\n7. Require a mobile food vendor to stay in constant motion\n\nexcept for when serving customers;\n\n8. Require a mobile food vendor to change locations unless the\n\nvendor is operating in violation of this act;\n\n9. Require a mobile food vendor to maintain insurance that\n\nnames a local authority as an additional insured unless the vendor\n\nis operating at an event sponsored by the local authority or\n\noperating in a local, public park;\n\n10. Require a mobile food vendor to maintain a bond that names\n\na local authority as a beneficiary unless the vendor is operating at\n\nan event sponsored by the local authority or operating in a local,\n\npublic park;\n\n11. Require a mobile food vendor to submit to health\n\ninspections beyond health inspections conducted by the Department or\n\nby a local authority collaborating with the Department, unless the\n\nDepartment is investigating a reported foodborne illness, or\n\naddressing a complaint of an imminent health or safety hazard to the\n\npublic;\n\n12. Require a health inspection of a food vending vehicle more\n\nthan twice per year unless the Department is ensuring a mobile food\n\nvendor has corrected a violation detected during a prior inspection,\n\nis investigating a reported foodborne illness, or is conducting a\n\nnonobstructive spot inspection to ensure food safety;\n\n13. Charge a mobile food vendor fees for a health inspection;\n\nor\n\n14.
