The local authority may regulate mobile food vendors in\n\naccordance with this section. In relation to a mobile food vendor's\n\noperations, a local authority may:\n\n1. Restrict the operation of a noisemaking device that exceeds\n\nseventy-five (75) decibels measured at twenty-three (23) feet from\n\nthe food vending vehicle during certain hours of the day;\n\n2. Restrict a mobile food vendor from operating in a public\n\npark or require a special permit and payment of fees to operate in a\n\npublic park;\n\n3. Prohibit a mobile food vendor from blocking or restricting\n\ningress to or egress from private property;\n\n4. Develop a mobile food vendor metered parking pass for a fee\n\nthat permits a mobile food vendor to operate from metered parking\n\nspaces for longer than the vendor would otherwise be permitted;\n\n5. Investigate reports of foodborne illnesses;\n\n6. Report a mobile food vendor's suspected violation of this\n\nact to the State Department of Health;\n\n7. Issue citations and penalties to mobile food vendors for\n\nviolations of state and local law not inconsistent with this act;\n\nand\n\n8. Adopt and enforce other regulations in conformity to\n\nmunicipal powers that are not inconsistent with this act. Any\n\nregulation regarding mobile food vendors must address public health\n\nor safety risks.\n\nB. In relation to a mobile food vendor's operations, a local\n\nauthority may not:\n\n1. Prohibit a mobile food vendor from lawfully operating in its\n\njurisdiction if the vendor holds a food establishment license\n\nrequired under Section 1-1118 of Title 63 of the Oklahoma Statutes\n\nand is in compliance with this act and all other state and local\n\nlaws not in conflict with this act;\n\n2. Require a mobile food vendor to obtain any license or permit\n\nfrom the local authority to operate a food vending vehicle unless:\n\na. the local authority is issuing a local license in\n\nrecognition of a state license under subsection B of\n\nSection 2 of this act,\n\nb. the mobile food vendor seeks to operate at an event\n\nwhich has been permitted by the local authority, or\n\nc. the mobile food vendor seeks a food establishment\n\nlicense from a local authority required by Section 1-\n\n1118 of Title 63 of the Oklahoma Statutes;\n\n3. Require a mobile food vendor that is operating on private\n\nproperty with the permission of the owner to operate a specific\n\ndistance from commercial food or retail establishments;\n\n4. Require a mobile food vendor to enter into any agreement\n\nwith commercial food or retail establishments;\n\n5. Require a mobile food vendor to be fingerprinted or to\n\ninstall a Global Positioning System (GPS) tracking device on the\n\nvendor's vehicle;\n\n6. Require a mobile food vendor to stay in constant motion\n\nexcept for when serving customers;\n\n7. Require a mobile food vendor to maintain an insurance policy\n\nthat names the local authority as an additional insured unless the\n\nvendor is operating at an event sponsored by the local authority or\n\noperating in a local, public park;\n\n8. Require a mobile food vendor to maintain a bond that names a\n\nlocal authority as a beneficiary unless the vendor is operating at\n\nan event sponsored by the local authority or operating in a local,\n\npublic park;\n\n9. Require a mobile food vendor to submit to health inspections\n\nbeyond health inspections conducted by or in collaboration with the\n\nDepartment, unless the local authority is investigating a reported\n\nfoodborne illness or addressing a complaint of an imminent health or\n\nsafety hazard to the public;\n\n10. Require a health inspection of a food vending vehicle more\n\nthan twice per year unless the local authority, in collaboration\n\nwith the Department under this act, is ensuring a mobile food vendor\n\nhas corrected a violation detected during a prior inspection, is\n\ninvestigating a reported foodborne illness, or is conducting a\ning a complaint of an imminent health or\n\nsafety hazard to the public;\n\n10. Require a health inspection of a food vending vehicle more\n\nthan twice per year unless the local authority, in collaboration\n\nwith the Department under this act, is ensuring a mobile food vendor\n\nhas corrected a violation detected during a prior inspection, is\n\ninvestigating a reported foodborne illness, or is conducting a\n\nnonobstructive spot inspection to ensure food safety;\n\n11. Charge a mobile food vendor fees for additional health\n\ninspections;\n\n12. Charge a mobile food vendor fees for any local license or\n\npermit allowed under Section 3 of this act beyond the administrative\n\ncost of issuing the local license or permit;\n\n13. Require a mobile food vendor to submit to a state fire\n\ninspection if the vendor can demonstrate it passed a state fire\n\ninspection in the previous twelve (12) months;\n\n14. Require a mobile food vendor to enter into any agreement\n\nwith a commercial establishment or restaurant;\n\n15. Regulate the equipment requirements for a food vending\n\nvehicle; or\n\n16.
