The Division of Health Care Information is hereby created\n\nwithin the State Department of Health.\n\nB. The Division shall:\n\n1. Collect from providers health care information for which the\n\nDivision has established a defined purpose and a demonstrated\n\nutility that is consistent with the intent of the provisions of\n\nSection 1-117 et seq. of this title;\n\n2. Establish and maintain a uniform health care information\n\nsystem;\n\n3. Analyze health care data submitted including, but not\n\nlimited to, geographic mapping of disease entities;\n\n4. Provide for dissemination of health care data to users and\n\nconsumers;\n\n5. Provide for the training and education of information\n\nproviders regarding processing and maintenance and methods of\n\nreporting required information;\n\n6. Be authorized to access all state agency health-related data\n\nsets and shall develop mechanisms for the receipt of health care\n\ndata to the Division or its agent; provided, however, all provisions\n\nfor confidentiality shall remain in place;\n\n7. Provide for the exchange of information with other agencies\n\nor political subdivisions of this state, the federal government or\n\nother states, or agencies thereof. The Division shall collaborate\n\nwith county health departments, including the Oklahoma City-County\n\nHealth Department and the Tulsa City-County Health Department, in\n\ndeveloping city-county based health data sets;\n\n8. Contract with other public or private entities for the\n\npurpose of collecting, processing or disseminating health care data;\n\n9. Build and maintain the data base; and\n\n10. In an effort to reduce deaths from sudden unexpected death\n\nin epilepsy (SUDEP), develop an information program in the Injury\n\nPrevention Service to be disseminated to the public and licensed\n\nmedical professionals to notify individuals with epilepsy of the\n\ndanger of SUDEP; and encourage the American Medical Association to\n\nadd a Current Procedural Terminology (CPT) Code for epilepsy\n\neducation by a medical service professional.\n\nC. 1. The State Board of Health shall adopt rules governing\n\nthe acquisition, compilation and dissemination of all data collected\n\npursuant to the Oklahoma Health Care Information System Act.\n\n2. The rules shall include, but not be limited to:\n\na. adequate measures to provide system security for all\n\ndata and information acquired pursuant to the Oklahoma\n\nHealth Care Information System Act,\n\nb. adequate procedures to ensure confidentiality of\n\npatient records,\n\nc. charges for users for the cost of data preparation for\n\ninformation that is beyond the routine data\n\ndisseminated by the office, and\n\nd. time limits for the submission of data by information\n\nproviders.\n\nD. The Division shall adopt standard nationally recognized\n\ncoding systems to ensure quality in receiving and processing data.\n\nE. The Division shall implement mechanisms to encrypt all\n\npersonal identifiers contained in any health care data upon\n\ntransmission to the State Department of Health, and all such data\n\nshall remain encrypted while maintained in the Department's database\n\nor while used by a contractor.\n\nF. The Division may contract with an organization for the\n\npurpose of data analysis. Any contract or renewal thereof shall be\n\nbased on the need for, and the feasibility, cost and performance of,\n\nservices provided by the organization. The Division shall require\n\nany data analyzer at a minimum to:\n\n1. Analyze the information;\n\n2. Prepare policy-related and other analytical reports as\n\ndetermined necessary for purposes of this act; and\n\n3. Protect the encryption and confidentiality of the data.\n\nG. The Board shall have the authority to set fees and charges\n\nwith regard to the collection and compilation of data requested for\n\nspecial reports, and for the dissemination of data. These funds\n\nshall be deposited in the Oklahoma Health Care Information System\n\nRevolving Fund account.\ndetermined necessary for purposes of this act; and\n\n3. Protect the encryption and confidentiality of the data.\n\nG. The Board shall have the authority to set fees and charges\n\nwith regard to the collection and compilation of data requested for\n\nspecial reports, and for the dissemination of data. These funds\n\nshall be deposited in the Oklahoma Health Care Information System\n\nRevolving Fund account.\n\nH. The Division may accept grants or charitable contributions\n\nfor use in carrying out the functions set forth in the Oklahoma\n\nHealth Care Information System Act from any source.
