Stat. tit. 63, § 63-1-120","heading":"Confidentiality of data - Disclosure upon court order -","body":"Immunity from liability.\n\nA. Except as otherwise provided by Section 1-119 of this title,\n\nthe individual forms, computer tapes, or other forms of data\n\ncollected by and furnished to the Division of Health Care\n\nInformation or to a data processor pursuant to the Oklahoma Health\n\nCare Information System Act shall be confidential and shall not be\n\npublic records as defined in the Oklahoma Open Records Act.\n\nB. After approval by the State Department of Health, the\n\ncompilations prepared for release or dissemination from the data\n\ncollected, except for a report prepared at the request of an\n\nindividual data provider containing information concerning only its\n\ntransactions, shall be public records.\n\nC. The confidentiality of identifying information is to be\n\nprotected and the pertinent statutes, rules and regulations of this\n\nstate and of the federal government relative to confidentiality\n\nshall apply.\n\nD. Identifying information shall not be disclosed, and shall\n\nnot be used for any purpose except for the creation and maintenance\n\nof anonymous medical case histories for statistical reporting and\n\ndata analysis.\n\nE. The Division or other state agency receiving information\n\npursuant to the Oklahoma Health Care Information System Act shall be\n\nsubject to the same confidentiality restrictions imposed by state or\n\nfederal law as the public or private agency providing the\n\ninformation and is prohibited from taking any administrative,\n\ninvestigative or other action with respect to any individual on the\n\nbasis of the identifying information. The Division data analyzer or\n\nother state agency receiving information pursuant to the Oklahoma\n\nHealth Care Information System Act is further prohibited from\n\nidentifying, directly or indirectly, any individual in any report of\n\nscientific research or long-term evaluation, or otherwise disclosing\n\nidentities in any manner.\n\nF. Except as otherwise authorized by the Oklahoma Health Care\n\nInformation System Act, identifying information submitted to the\n\nDivision which would directly or indirectly identify any person\n\nshall not be disclosed by the Division either voluntarily or in\n\nresponse to any legal process, unless directed to by a court of\n\ncompetent jurisdiction, granted after application showing good cause\n\ntherefor with notice of the hearing to the Division. In assessing\n\ngood cause the court shall only grant such application if it seeks\n\nto challenge the statistical efficacy of a finding made by the\n\nDivision or alleges a violation of confidentiality by the Division.\n\nSuch application shall then be granted only when the public interest\n\nand the need for disclosure outweighs the injury to the person, to\n\nthe physician-patient relationship, and to the treatment services.\n\nUpon the granting of such order, the court, in determining the\n\nextent to which any disclosure of all or any part of any record is\n\nnecessary, shall impose appropriate safeguards against unauthorized\n\ndisclosure.\n\nG. Any person who submits or receives data as required or\n\nauthorized by the Oklahoma Health Care Information System Act shall\n\nbe immune from liability in any civil action for any action taken as\n\nrequired by the provisions of the Oklahoma Health Care Information\n\nSystem Act. This immunity is in addition to any other immunity for\n\nthe same or similar acts to which the person is otherwise entitled.\n\nH.
