Mello-drink products shall not be advertised, displayed for\n\nsale or sold in any manner or under any circumstances or conditions\n\nlikely to mislead, deceive or confuse the public into believing such\n\nproduct is a milk product.\n\nB. No wording commonly used or associated with or which may be\n\nassociated with the production, sale, advertising, distribution or\n\nmarketing of a milk product, whether in liquid, powdered, frozen or\n\nany other form, shall be used with or without additional descriptive\n\nwords on any label, package or wrapping of any Mello-drink product\n\nor advertisement thereof, whether such use be by word, sound or\n\nother technique or device. These provisions shall not apply to food\n\nprepared in restaurants or cafeterias.\n\nC. No picture or representation of the animal genus bovine or\n\nany other picture, symbol, mark, design or representation commonly\n\nassociated with dairy farming or any other phase of the dairy\n\nindustry or associated with the production, sale, advertising,\n\ndistribution or marketing of milk products, whether in liquid,\n\npowdered, frozen or any other form, shall be used on any label,\n\npackage or wrapping of any Mello-drink product or when advertising\n\nany Mello-drink product.\n\nD. No Mello-drink product shall be advertised or labeled as\n\npasteurized or homogenized unless the whole finished product has\n\nbeen pasteurized, homogenized or processed in a licensed\n\nmanufacturing plant in accordance with the requirements of this act.\n\nE. The label, package or wrapping of a Mello-drink product shall\n\ncontain an accurate and complete listing of the ingredients preceded\n\nby the words \"ingredients: vegetable oil beverage consisting of\".\n\nThe common name of each ingredient shall be listed in order of\n\ndecreasing predominance, each accompanied by the percentage it\n\nrepresents of the whole product. Ingredients which represent less\n\nthan one percent (1%) of the whole product shall be preceded by the\n\nwords \"consisting of less than one percent (1%)\". The oil or fat\n\ncontained in the product shall be listed by the common name given\n\nits specific type. If artificial coloring or flavoring has been\n\nadded, the list of ingredients shall so state.\n\nF. The label, package or wrapping of a Mello-drink product may\n\ncontain statements and claims which are reasonable, relevant,\n\ntruthful, complete and not deceptive or misleading, provided the\n\nlabel shall contain no statements or claims regarding milk products,\n\nexcept any necessary factual statement regarding any milk products\n\nwhich are ingredients of the Mello-drink product. The Department\n\nmay require satisfactory proof of the compliance of any statement or\n\nclaim with the provisions of this subsection. The Department may\n\nrequire such disclaimers be placed on the label, package or wrapping\n\nas it determines necessary to avoid confusion and deception of the\n\npublic and as are consistent with other provisions of this act.\n\nG. The Board shall by rule or regulation establish the size,\n\nincluding type size, and the location of all terms, pictures,\n\nsymbols, marks, designs or other representations to be placed on the\n\nlabel, package or wrapping of a Mello-drink product so that the\n\nlabel, package or wrapping is not likely to mislead, deceive or\n\nconfuse the public as to the true nature or character of the\n\nproduct. In no event shall the product name, Mello-drink, be less\n\nthan twice the type size of any other term or representation\n\ncontained on the label, package or wrapping.
