The Department shall make and enforce all rules, regulations\n\nand orders that are necessary to carry out the purposes of this act,\n\nto protect the public health and welfare and to prevent deception or\n\nconfusion among consumers; providing the Department shall not make\n\nany rules, regulations, or orders, regarding signs or statements to\n\nbe used in food establishments, other than those specifically\n\nrequired in this act. The Department shall designate the various\n\nMello-drink products in order to facilitate the adoption and\n\nenforcement of rules, regulations and orders.\n\nB. The Board is hereby authorized and directed to establish, by\n\nregulations, the sanitary requirements for the processing,\n\nmanufacturing, distribution and sale of Mello-drink products.\n\nC. Notwithstanding any other provisions of this act to the\n\ncontrary, the Board may by regulation waive any of the provisions of\n\nthis act as they may apply to Mello-drink products manufactured for\n\nsale and distribution exclusively outside of this state; provided\n\nthat the regulations contain provisions ensuring that the products\n\nwill not be made available or sold to consumers in this state.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"2ae8cd837ebe980b5037867907977ad63045bb17c9ab777bbf802935143af1ab","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1301.38","next":"us-ok/okla.-stat.-tit.-63-63-1-1301.4"},"notice":"GroundRules: Original legal text.
