The term \"drug\" means:\n\n1. Articles recognized in the official United States\n\nPharmacopoeia, official Homeopathic Pharmacopoeia of the United\n\nStates, or official National Formulary, or any supplement to any of\n\nthem;\n\n2. Articles intended for use in the diagnosis, cure,\n\nmitigation, treatment or prevention of disease in man or other\n\nanimals;\n\n3. Articles, other than food, intended to affect the structure\n\nor any function of the body of man or other animals; and\n\n4. Articles intended for use as a component of any article\n\nspecified in paragraphs 1, 2 and 3 of this subsection; but does not\n\ninclude devices or their components, parts or accessories.\n\nB. The term \"device\", except when used in subsection K of this\n\nsection and in subsection (i) of Section 1-1402, subsection (c) of\n\nSection 1-1409, and subsection (c) of Section 1-1411 of this title,\n\nmeans instruments, apparatus and contrivances, including their\n\ncomponents, parts and accessories, intended:\n\n1. For use in the diagnosis, cure, mitigation, treatment, or\n\nprevention of disease in man or other animals; or\n\n2. To affect the structure or any function of the body of man\n\nor other animals.\n\nC. The term \"cosmetic\" means:\n\n1. Articles intended to be rubbed, poured, sprinkled or sprayed\n\non, introduced into, or otherwise applied to the human body or any\n\npart thereof for cleansing, beautifying, promoting attractiveness or\n\naltering the appearance; and\n\n2. Articles intended for use as a component of any such\n\narticles, except that such term shall not include soap.\n\nD. The term \"official compendium\" means authoritative compendia\n\nas identified by the Secretary of the United States Department of\n\nHealth and Human Services.\n\nE. The term \"label\" means a display of written, printed or\n\ngraphic matter upon the immediate container of any article; and a\n\nrequirement made by or under authority of this article that any\n\nword, statement, or other information appear on the label shall not\n\nbe considered to be complied with unless such work, statement, or\n\nother information also appears on the outside container or wrapper,\n\nif any there be, of the retail package of such article, or is easily\n\nlegible through the outside container or wrapper.\n\nF. The term \"immediate container\" does not include package\n\nliners.\n\nG. The term \"labeling\" means all labels and other written,\n\nprinted or graphic matter:\n\n1. Upon an article or any of its containers or wrappers; or\n\n2. Accompanying such article.\n\nH. If an article is alleged to be misbranded because the\n\nlabeling is misleading, or if an advertisement is alleged to be\n\nfalse because it is misleading, then, in determining whether the\n\nlabeling or advertisement is misleading, there shall be taken into\n\naccount (among other things) not only representations made or\n\nsuggested by statement, word, design, device, sound, or in any\n\ncombination thereof, but also the extent to which the labeling or\n\nadvertisement fails to reveal facts material in the light of such\n\nrepresentations or material with respect to consequences which may\n\nresult from the use of the article to which the labeling or\n\nadvertisement relates under the conditions of use prescribed in the\n\nlabeling or advertisement thereof or under such conditions of use as\n\nare customary or usual.\n\nI. The term \"advertisement\" means all representations\n\ndisseminated in any manner or by any means, other than labeling, for\n\nthe purpose of inducing, or which are likely to induce, directly or\n\nindirectly, the purchase of drugs, devices, or cosmetics.\n\nJ. The representation of a drug, in its labeling or\n\nadvertisement, as an antiseptic shall be considered to be a\n\nrepresentation that it is a germicide, except in the case of a drug\n\npurporting to be, or represented as, an antiseptic for inhibitory\n\nuse as a wet dressing, ointment, dusting powder, or such other use\n\nas involves prolonged contact with the body.\nase of drugs, devices, or cosmetics.\n\nJ. The term \"contaminated with filth\" applies to any drug,\n\ndevice, or cosmetic not securely protected from dust, dirt, and, as\n\nfar as may be necessary by all reasonable means, from all foreign or\n\ninjurious contaminations.\n\nL. The provisions of this article regarding the selling of\n\ndrugs, devices, or cosmetics shall be considered to include the\n\nmanufacture, production, processing, packing, exposure, offer,\n\npossession, and holding of any such article for sale; and the sale,\n\ndispensing, and giving of any such article, and the supplying or\n\napplying of any such article in the conduct of any drug or cosmetic\n\nmanufacturing establishment.\n\nM.
