Stat. tit. 63, § 63-1-1408","heading":"Adulteration of drugs and devices","body":"A drug or device shall be deemed to be adulterated:\n\n1. If it consists in whole or in part of any filthy, putrid or\n\ndecomposed substance;\n\n2. If it has been produced, prepared, packed or held under\n\nunsanitary conditions whereby it may have been contaminated with\n\nfilth, or whereby it may have been rendered injurious to health;\n\n3. If it is a drug and its container is composed, in whole or\n\nin part, of any poisonous or deleterious substance which may render\n\nthe contents injurious to health;\n\n4. If it is a drug and it bears or contains, for purposes of\n\ncoloring only, a coal tar color other than one from a batch\n\ncertified under the authority of the Federal Food, Drug and Cosmetic\n\nAct, 21 U.S.C., Section 301 et seq.;\n\n5. If it purports to be or is represented as a drug the name of\n\nwhich is recognized in an official compendium, and its strength\n\ndiffers from, or its quality or purity falls below, the standard set\n\nforth in such compendium. Such determination as to strength,\n\nquality or purity shall be made in accordance with the tests or\n\nmethods of assay set forth in such compendium, or, in the absence of\n\nor inadequacy of such tests or methods of assay, those prescribed\n\nunder authority of the federal act. No drug defined in an official\n\ncompendium shall be deemed to be adulterated under this paragraph\n\nbecause it differs from the standard of strength, quality or purity\n\ntherefor set forth in such compendium, if its difference in\n\nstrength, quality or purity from such standard is plainly stated on\n\nits label. Whenever a drug is recognized in both the United States\n\nPharmacopoeia and the Homoeopathic Pharmacopoeia of the United\n\nStates it shall be subject to the requirements of the United States\n\nPharmacopoeia unless it is labeled and offered for sale as a\n\nhomoeopathic drug, in which case it shall be subject to the\n\nprovisions of the Homoeopathic Pharmacopoeia of the United States\n\nand not to those of the United States Pharmacopoeia;\n\n6. If it is not subject to the provisions of paragraph 2 of\n\nthis section and its strength differs from, or its purity or quality\n\nfalls below, that which it purports or is represented to possess;\n\n7. If it is a drug and any substance has been:\n\na. mixed or packed therewith so as to reduce its quality\n\nor strength, or\n\nb. substituted wholly or in part therefor; or\n\n8.
