Stat. tit. 63, § 63-1-1412","heading":"Advertisements - False or misleading","body":"(a) An advertisement of a drug, device, or cosmetic shall be\n\ndeemed to be false if it is false or misleading in any particular.\n\n(b) For the purposes of this article, the advertisement of a\n\ndrug or device representing it to have any effect in albuminuria,\n\nappendicitis, arteriosclerosis, blood poison, bone disease, Bright's\n\ndisease, cancer, carbuncles, cholecystitis, diabetes, diphtheria,\n\ndropsy, erysipelas, gallstone, heart and vascular diseases, high\n\nblood pressure, mastoiditis, measles, meningitis, mumps, nephritis,\n\notitis media, paralysis, pneumonia, poliomyelitis (infantile\n\nparalysis), prostate gland disorders, pyelitis, scarlet fever,\n\nsexual impotence, sinus infection, smallpox, tuberculosis, tumors,\n\ntyphoid, uremia, or sexually transmitted infection (STI) shall also\n\nbe deemed to be false, except that no advertisement not in violation\n\nof subsection (a) of this section shall be deemed to be false under\n\nthis subsection if it is disseminated only to members of the\n\nmedical, dental, or veterinary professions, or appears only in\n\nscientific periodicals of those professions, or is disseminated only\n\nfor the purpose of public health education by persons not\n\ncommercially interested, directly or indirectly, in the sale of\n\ndrugs or devices; provided, that whenever the State Commissioner of\n\nHealth determines that an advance in medical science has made any\n\ntype of self-medication safe as to any of the diseases named above,\n\nthe State Board of Health shall by regulation authorize the\n\nadvertisement of drugs having curative or therapeutic effect for\n\nsuch disease, subject to such conditions and restrictions as the\n\nBoard and the Commissioner may deem necessary in the interests of\n\npublic health; provided, that this subsection shall not be construed\n\nas indicating that self-medication for disease other than those\n\nnamed herein is safe or efficacious.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"7da9b3da4147344ef5d8db1f219b53ff77bf8e82ae411a53eff87775edf8ae97","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1411","next":"us-ok/okla.-stat.-tit.-63-63-1-1413"},"notice":"GroundRules: Original legal text.
