Stat. tit. 63, § 63-1-1432.2","heading":"Definitions","body":"As used in the Oklahoma Kratom Consumer Protection Act:\n\n1. “Food” means a food, food product, food ingredient, dietary\n\ningredient, dietary supplement or beverage for human consumption;\n\n2. “Independent testing laboratory” means a laboratory that:\n\na. does not have a direct or indirect interest in the\n\nentity whose product is being tested,\n\nb. does not have a direct or indirect interest in a\n\nfacility that processes, distributes, dispenses, or\n\nsells kratom products in this state or in another\n\njurisdiction, and\n\nc. is nationally accredited by an accrediting body as\n\ndefined by Section 150.37 of Title 74 of the Oklahoma\n\nStatutes;\n\n3. “Kratom leaf” means the leaf of the kratom plant, Mitragyna\n\nspeciosa, in fresh or dehydrated or dried form that undergoes no\n\npost-harvest processing other than drying or size reduction by\n\ncutting, milling, or similar procedure, and may be cleaned or\n\nsterilized using standard treatments applied to food ingredients,\n\nsuch as heat, steam, pressurization, or irradiation or other\n\nstandard treatments applied to food ingredients. The total alkaloid\n\ncontent of kratom leaf material used in the kratom product shall not\n\nexceed three and one-half percent (3.5%) measured on a dried weight-\n\nto-weight basis;\n\n4. “Kratom leaf extract” means the material obtained by\n\nextracting kratom using a solvent consisting of:\n\na. water, ethanol, or food-grade carbon dioxide (CO ), or\n\n2\n\nb. any other solvent allowed by federal or state\n\nregulation for use in manufacturing a food ingredient.\n\nThe extracted material shall contain mitragynine as the most\n\nabundant alkaloid, measured on a weight-to-weight basis;\n\n5. “Kratom product” means a food or dietary supplement that\n\nconsists of or contains kratom leaf or kratom leaf extract that does\n\nnot contain any synthesized kratom alkaloids, other synthesized\n\nkratom constituents, or synthesized metabolites of any kratom\n\nconstituent in which the level of 7-hydroxymitragynine, on a percent\n\nweight basis, is not greater than one percent (1%) of the amount of\n\ntotal kratom alkaloids, as confirmed with a high-performance liquid\n\nchromatography testing method. For purposes of this paragraph,\n\n“synthesized” refers to substances produced using directed synthetic\n\nor biosynthetic chemistry, as opposed to traditional food\n\npreparation techniques such as heating or extracting;\n\n6. “Total kratom alkaloids” means the sum of mitragynine,\n\nspeciociliatine, speciogynine, paynantheine, and 7-\n\nhydroxymitragynine; and\n\n7. “Vendor” means a person or entity that sells, prepares or\n\nmaintains kratom products or that advertises, represents, or holds\n\nhimself, herself, or itself out as selling, preparing or maintaining\n\nkratom products and includes a manufacturer, wholesaler, store,\n\nrestaurant, hotel, catering facility, camp, bakery, delicatessen,\n\nsupermarket, grocery store, convenience store, nursing home, or food\n\nor drink company.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"ece68fe681bc10f079ddb3d61b5afd1a336f7eff25e2c456cb863b372624ed45","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1432.1","next":"us-ok/okla.-stat.-tit.-63-63-1-1432.3"},"notice":"GroundRules: Original legal text.
