On and after May 1, 2002, except for a physician, any person\n\nintending to perform medical micropigmentation in this state shall\n\nfirst be certified by the State Department of Health.\n\nB. The State Commissioner of Health shall not issue a\n\ncertificate or renew a certificate to perform medical\n\nmicropigmentation to a person who has:\n\n1. Been convicted of or pled guilty or nolo contendere to a\n\nfelony crime that substantially relates to the practice of medical\n\nmicropigmentation and poses a reasonable threat to public safety;\n\n2. Been determined to have engaged in unprofessional conduct as\n\ndefined by the rules promulgated by the State Board of Health;\n\n3. Made a materially false or fraudulent statement in an\n\napplication or other document relating to certification pursuant to\n\nthe provisions of the Oklahoma Medical Micropigmentation Regulation\n\nAct; or\n\n4. Had a health-related license, certificate, or permit\n\nsuspended, revoked or not renewed or had any other disciplinary\n\naction taken, or had an application for a health-related license,\n\ncertificate, or permit refused by a federal, state, territory, or\n\nDistrict of Columbia regulatory authority for intentionally\n\nfalsifying information.\n\nC. In order to qualify for certification, an applicant shall:\n\n1. Have received a high school diploma or its equivalent;\n\n2. Be at least twenty-one (21) years of age; and\n\n3. Have submitted a completed application to the Department in\n\nsuch form as required by the Department which shall include a\n\nnotarized copy of:\n\na. the certificate of birth of the applicant,\n\nb. the applicant's driver license or other similar form\n\nof identification,\n\nc. other professional credentials, if applicable, and\n\nd. proof, in such form as the Department determines\n\nappropriate, of the satisfactory completion of a\n\nprogram of training and testing approved by the\n\nDepartment as specified in Section 1-1455 of this\n\ntitle.\n\nD. Upon meeting the requirements of the Oklahoma Medical\n\nMicropigmentation Regulation Act and rules promulgated pursuant\n\nthereto, the State Commissioner of Health shall issue a certificate\n\nto perform medical micropigmentation to the applicant.\n\nE. As used in this section:\n\n1. \"Substantially relates\" means the nature of criminal conduct\n\nfor which the person was convicted has a direct bearing on the\n\nfitness or ability to perform one or more of the duties or\n\nresponsibilities necessarily related to the occupation; and\n\n2. \"Poses a reasonable threat\" means the nature of criminal\n\nconduct for which the person was convicted involved an act or threat\n\nof harm against another and has a bearing on the fitness or ability\n\nto serve the public or work with others in the occupation.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"f779c4a92f9130c0822e89e633b84c3f46921ea1d73ad80855d769bb2e2272bd","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1453","next":"us-ok/okla.-stat.-tit.-63-63-1-1455"},"notice":"GroundRules: Original legal text.
