Upon receipt of a complaint by a licensing board relating to\n\na violation of the Oklahoma Medical Micropigmentation Regulation Act\n\nor any rules promulgated thereto, the licensing board shall cause an\n\ninvestigation to be made. If during the investigation, the\n\nlicensing board determines that the alleged violation of the\n\nOklahoma Medical Micropigmentation Regulation Act or any rules\n\npromulgated thereto may have been committed by any person other than\n\na physician or any other person subject to the licensing board’s\n\nregulatory authority, the licensing board shall immediately notify\n\nthe Oklahoma State Department of Health.\n\nB. 1. Upon receipt of a complaint by the Department or upon\n\nreceipt of notice pursuant to subsection A of this section relating\n\nto an alleged violation of the Oklahoma Medical Micropigmentation\n\nRegulation Act or rules promulgated thereto which involve the\n\npractice of micropigmentation in the office of a physician, the\n\nDepartment shall:\n\na. notify the appropriate licensing board of the\n\ncomplaint and request a joint inspection, or\n\nb. refer the complaint to the appropriate licensing board\n\nfor investigation.\n\n2. The licensing boards shall give priority to investigations\n\nof complaints for which the Department has requested a joint\n\ninspection.\n\nC. 1. If a person other than a physician, after proper notice\n\nand hearing as provided in the Administrative Procedures Act, is\n\nfound to have violated one or more provisions of the Oklahoma\n\nMedical Micropigmentation Regulation Act, the State Department of\n\nHealth may impose one or more of the following penalties:\n\na. suspend or revoke a certificate,\n\nb. seek injunctive relief,\n\nc. reprimand the certificate holder,\n\nd. place a certificate holder on probation for a\n\nspecified period of time,\n\ne. deny renewal of a certificate,\n\nf. require a special quality review of the certificate\n\nholder, subject to such procedures as the Department\n\nby rule deems appropriate,\n\ng. require the person or entity to pay all costs incurred\n\nas a result of hearings conducted regarding actions of\n\nthe subject of the hearing including, but not limited\n\nto, investigation costs, hearing officer costs,\n\nrenting of special facilities costs, and court\n\nreporter costs, or\n\nh. in addition to any criminal penalty imposed pursuant\n\nto the Oklahoma Medical Micropigmentation Regulation\n\nAct, assess an administrative penalty not to exceed\n\nTen Thousand Dollars ($10,000.00).\n\n2. Any physician alleged to have violated the Oklahoma Medical\n\nMicropigmentation Regulation Act or rules promulgated by the\n\nlicensing board thereto shall be subject to penalties established\n\npursuant to law by the licensing board which has authority to\n\nregulate the physician.\n\nB. In addition to the penalties provided for in subsection A of\n\nthis section, the Department may request the district attorney to\n\nbring an action in the district court for the prosecution of any\n\nperson for a violation of any provision of the Oklahoma Medical\n\nMicropigmentation Regulation Act, or order issued or rules\n\npromulgated pursuant thereto.\n\nC. Upon application in writing and upon good cause, the\n\nDepartment may reinstate a certificate which has been revoked or\n\nsuspended or may modify the certificate when reinstated. A person\n\nwhose certificate has been revoked or suspended may not reapply for\n\nreinstatement during the time period set by the Department which\n\nshall not exceed five (5) years.\n\nD. 1. Administrative penalties assessed by the Department\n\nunder the provisions of the Oklahoma Medical Micropigmentation\n\nRegulation Act shall be imposed and enforced pursuant to the\n\nAdministrative Procedures Act and may be enforced in district court\n\nas authorized by the Administrative Procedures Act.\n\n2. All monies, excluding costs, collected from administrative\nall not exceed five (5) years.\n\nD. 1. Administrative penalties assessed by the Department\n\nunder the provisions of the Oklahoma Medical Micropigmentation\n\nRegulation Act shall be imposed and enforced pursuant to the\n\nAdministrative Procedures Act and may be enforced in district court\n\nas authorized by the Administrative Procedures Act.\n\n2. All monies, excluding costs, collected from administrative\n\npenalties authorized in this section, shall be deposited pursuant to\n\nSection 1-1701.1B of Title 63 of the Oklahoma Statutes.\n\nE. Any person convicted of violating the provisions of the\n\nOklahoma Medical Micropigmentation Regulation Act or orders issued\n\nor rules promulgated pursuant thereto shall be guilty of a\n\nmisdemeanor punishable by imprisonment in the county jail not to\n\nexceed ninety (90) days, a fine of not more than One Thousand\n\nDollars ($1,000.00), or by both such fine and imprisonment. Each\n\nday upon which such violation occurs shall constitute a separate\n\nviolation.\n\nF. The provisions of this section shall apply to:\n\n1. Any person certified to perform medical micropigmentation\n\npursuant to the Oklahoma Medical Micropigmentation Regulation Act\n\nand who is alleged to be in violation of the Oklahoma Medical\n\nMicropigmentation Regulation Act or rule or order issued pursuant\n\nthereto; and\n\n2.
