Stat. tit. 63, § 63-1-1515","heading":"Clean Air in Restaurants Act - Restaurant rebate","body":"program.\n\nA. This section shall be known and may be cited as the “Clean\n\nAir in Restaurants Act”.\n\nB. The Legislature hereby finds:\n\n1. Numerous studies have found that tobacco smoke is a major\n\ncontributor to indoor air pollution;\n\n2. Reliable studies have shown that breathing secondhand smoke\n\nis a cause of disease, including lung cancer, in healthy nonsmokers.\n\nAt special risk are elderly people, children, people with\n\ncardiovascular disease, and individuals with impaired respiratory\n\nfunction, including asthmatics and those with obstructive airway\n\ndisease; and\n\n3. Health hazards induced by breathing secondhand smoke include\n\nlung cancer, respiratory infection, decreased exercise tolerance,\n\ndecreased respiratory function, bronchoconstriction, and\n\nbronchospasm.\n\nC. 1. The State Department of Health is hereby authorized to\n\nimplement a rebate program for the purpose of reimbursing persons or\n\nentities that own restaurants located in this state for expenses\n\nincurred prior to November 1, 2010, in complying with the\n\nrequirements imposed by subsection J of Section 1247 of Title 21 of\n\nthe Oklahoma Statutes. The rebate shall be equal to fifty percent\n\n(50%) of the original expenditure, minus depreciation costs, and\n\nshall only be disbursed if the restaurant converts to a completely\n\nsmoke-free environment no later than January 1, 2013.\n\n2. The Department shall be required to utilize the proceeds\n\ngenerated by the Tobacco Prevention and Cessation Revolving Fund in\n\nfunding the rebate program and shall promulgate such rules as are\n\nnecessary to implement the provisions of the program.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"105c50bf2a2c608ec8c906c131de36a35e5a3a3a7f328c159b4f15881d509ec4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1514","next":"us-ok/okla.-stat.-tit.-63-63-1-1521"},"notice":"GroundRules: Original legal text.
