Stat. tit. 63, § 63-1-1601","heading":"Definitions","body":"For the purposes of this article:\n\n(a) The term \"hazardous substance\" means:\n\n(1) a. any substance or mixture of substances intended or\n\nsuitable for household use which (1) is toxic, (2) is corrosive, (3)\n\nis an irritant, (4) is a strong sensitizer, (5) is flammable, or (6)\n\ngenerates pressure through decomposition, heat, or other means, if\n\nsuch substance or mixture of substances may cause substantial\n\npersonal injury or substantial illness during or as a proximate\n\nresult of any customary or reasonably foreseeable handling or use,\n\nincluding reasonably foreseeable ingestion by children.\n\nb. any substances which the State Board of Health by regulation\n\nfinds, pursuant to the provisions of Section 1602(a), meet the\n\nrequirements of subparagraph 1.a. of this paragraph.\n\nc. any radioactive substance, if, with respect to such\n\nsubstance as used in a particular class of article or as packaged,\n\nthe Board determines by regulation that the substance is\n\nsufficiently hazardous to require labeling in accordance with this\n\narticle in order to protect the public health.\n\n(2) The term \"hazardous substance\" shall not apply (1) to\n\neconomic poisons subject to the provisions of 2 O.S.1961, Section 3-\n\n63; (2) to foods subject to the provisions of Article 11 of this\n\nCode; (3) to drugs and cosmetics subject to the provisions of\n\nArticle 14 of this Code; (4) to substances intended for use as fuels\n\nwhen stored in containers and used in heating, cooking, or\n\nrefrigeration system of a house.\n\n(3) The term \"hazardous substance\" shall not include any source\n\nmaterial, special nuclear material, or by-product material as\n\ndefined in the Act of Congress known as the Atomic Energy Act of\n\n1954, as amended, and regulations issued pursuant thereto by the\n\nAtomic Energy Commission.\n\n(b) The term \"toxic\" shall apply to any substance (other than a\n\nradioactive substance) which has the capacity to produce personal\n\ninjury or illness to man through ingestion, inhalation, or\n\nabsorption through any body surface.\n\n(c) (1) The term \"highly toxic\" means any substance which falls\n\nwithin any of the following categories: a. produces death within\n\nfourteen (14) days in half or more than half of a group of ten or\n\nmore laboratory white rats each weighing between two hundred (200)\n\nand three hundred (300) grams, at a single dose of fifty (50)\n\nmilligrams or less per kilogram of body weight, when orally\n\nadministered; or b. produces death within fourteen (14) days in\n\nhalf or more than half of a group of ten or more laboratory white\n\nrats each weighing between two hundred (200) and three hundred (300)\n\ngrams, when inhaled continuously for a period of one (1) hour or\n\nless at an atmospheric concentration of two hundred (200) parts per\n\nmillion by volume or less of gas or vapor or two (2) milligrams per\n\nliter by volume or less of mist or dust, provided such concentration\n\nis likely to be encountered by man when the substance is used in any\n\nreasonably foreseeable manner; or c. produces death within fourteen\n\n(14) days in half or more than half of a group of ten or more\n\nrabbits tested in a dosage of two hundred (200) milligrams or less\n\nper kilogram of body weight, when administered by continuous contact\n\nwith the bare skin for twenty-four (24) hours or less.\n\n(2) If the Board finds that available data on human experience\n\nwith any substance indicates results different from those obtained\n\non animals in the above-named dosages or concentrations, the human\n\ndata shall take precedence.\n\n(d) The term \"corrosive\" means any substance which in contact\n\nwith living tissue will cause destruction of tissue by chemical\n\naction; but shall not refer to action on inanimate surfaces.\n\n(e) The term \"irritant\" means any substance not corrosive within\n\nthe meaning of the preceding subparagraph which on immediate,\n\nprolonged, or repeated contact with normal living tissue will induce\n\na local inflammatory reaction.\nsive\" means any substance which in contact\n\nwith living tissue will cause destruction of tissue by chemical\n\naction; but shall not refer to action on inanimate surfaces.\n\n(e) The term \"irritant\" means any substance not corrosive within\n\nthe meaning of the preceding subparagraph which on immediate,\n\nprolonged, or repeated contact with normal living tissue will induce\n\na local inflammatory reaction.\n\n(f) The term \"strong sensitizer\" means a substance which will\n\ncause on normal living tissue through an allergic or photodynamic\n\nprocess a hypersensitivity which becomes evident on reapplication of\n\nthe same substance and which is designated as such by the Board.\n\nBefore designating any substance as a strong sensitizer, the Board,\n\nupon consideration of the frequency of occurrence and severity of\n\nthe reaction, shall find that the substance has a significant\n\npotential for causing hypersensitivity.\n\n(g) The term \"extremely flammable\" shall apply to any substance\n\nwhich has a flash point at or below twenty degrees Fahrenheit (20F.)\n\nas determined by the Tagliabue Open Cup Tester, and the term\n\n\"flammable\" shall apply to any substance which has a flash point of\n\nabove twenty degrees (20) to and including eighty (80) (80F.)\n\ndegrees Fahrenheit, as determined by the Tagliabue Open Cup Tester;\n\nexcept that the flammability of solids and of the contents of self-\n\npressurized containers shall be determined by methods found by the\n\nBoard to be generally applicable to such materials or containers,\n\nrespectively, and established by regulations issued by the Board,\n\nwhich regulations shall also define the terms \"flammable\" and\n\n\"extremely flammable\" in accord with such methods.\n\n(h) The term \"radioactive substance\" means a substance which\n\nemits ionizing radiation.\n\n(i) The term \"label\" means a display of written, printed, or\n\ngraphic matter upon the immediate container of any substance; and a\n\nrequirement made by or under authority of this article that any\n\nword, statement, or other information appearing on the label shall\n\nnot be considered to be complied with unless such word, statement,\n\nor other information also appears (1) on the outside container or\n\nwrapper, if any there be, unless it is easily legible through the\n\noutside container or wrapper, and (2) on all accompanying literature\n\nwhere there are directions for use, written or otherwise.\n\n(j) The term \"immediate container\" does not include package\n\nliners.\n\n(k) The term \"misbranded package\" or \"misbranded package of a\n\nhazardous substance\" means a hazardous substance in a container\n\nintended or suitable for household use which, except as otherwise\n\nprovided by or pursuant to Section 1602, fails to bear a label:\n\n(1) Which states conspicuously (a) the name and place of\n\nbusiness of the manufacturer, packer, distributor, or seller; (b)\n\nthe common or usual name or the chemical name (if there be no common\n\nor usual name) of the hazardous substance or of each component which\n\ncontributes substantially to its hazard, unless the Board by\n\nregulation permits or requires the use of a recognized generic name;\n\n(c) the signal word \"DANGER\" on substances which are extremely\n\nflammable, corrosive, or highly toxic; (d) the signal word \"WARNING\"\n\nor \"CAUTION\" on all other hazardous substances; (e) an affirmative\n\nstatement of the principal hazard or hazards, such as \"Flammable,\"\n\n\"Vapor Harmful,\" \"Causes Burns,\" \"Absorbed Through Skin,\" or similar\n\nwording descriptive of the hazard; (f) precautionary measures\n\ndescribing the action to be followed or avoided, except when\n\nmodified by regulation of the Board pursuant to Section 1602; (g)\n\ninstruction, when necessary or appropriate, for first aid treatment;\nstatement of the principal hazard or hazards, such as \"Flammable,\"\n\n\"Vapor Harmful,\" \"Causes Burns,\" \"Absorbed Through Skin,\" or similar\n\nwording descriptive of the hazard; (f) precautionary measures\n\ndescribing the action to be followed or avoided, except when\n\nmodified by regulation of the Board pursuant to Section 1602; (g)\n\ninstruction, when necessary or appropriate, for first aid treatment;\n\n(h) the word \"Poison\" for any hazardous substance which is defined\n\nas \"Highly Toxic\" by subsection (c) (1);
