Stat. tit. 63, § 63-1-1602","heading":"Regulations - State Board of Health","body":"\n\n(a) Whenever in the judgment of the Board such action will\n\npromote the objectives of this article by avoiding or resolving\n\nuncertainty as to its application, the Board may by regulation\n\ndeclare to be a hazardous substance, for the purposes of this\n\narticle, any substance or mixture of substances which it finds meets\n\nthe requirements of subparagraph (1) a. of Section 1601(a).\n\n(b) If the Board finds that the requirements of section 1601(k)\n\n(1) are not adequate for the protection of the public health and\n\nsafety in view of the special hazard presented by any particular\n\nhazardous substance, it may by regulation establish such reasonable\n\nvariations or additional label requirements as it finds necessary\n\nfor the protection of the public health and safety; and any\n\ncontainer of such hazardous substance intended or suitable for\n\nhousehold use which fails to bear a label in accordance with such\n\nregulations shall be deemed to be a misbranded package of a\n\nhazardous substance.\n\n(c) If the Board finds that, because of the size of the package\n\ninvolved or because of the minor hazard presented by the substance\n\ncontained therein, or for other good and sufficient reasons, full\n\ncompliance with the labeling requirements otherwise applicable under\n\nthis article is impracticable or is not necessary for the adequate\n\nprotection of the public health and safety, the Board shall\n\npromulgate regulations exempting such substance from these\n\nrequirements to the extent it determines to be consistent with\n\nadequate protection of the public health and safety.\n\n(d) The Board may exempt from the requirements established by or\n\npursuant to this Article any container of a hazardous substance with\n\nrespect to which the Board finds that adequate requirements\n\nsatisfying the purposes of this article have been established by or\n\npursuant to any other state law.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"0e629d80ec99ace49266bd705748c297a7d68dc4eae825df1ab101e47ad572a6","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1601","next":"us-ok/okla.-stat.-tit.-63-63-1-1603"},"notice":"GroundRules: Original legal text.
