Stat. tit. 63, § 63-1-1604","heading":"Violations - Penalties - Exemptions","body":"(a) Any person who violates any of the provisions of Section\n\n1603 shall be guilty of a misdemeanor and shall on conviction\n\nthereof be subject to a fine of not more than Five Hundred Dollars\n\n($500.00), or to imprisonment for not more than ninety (90) days, or\n\nboth; but for offenses committed with intent to defraud or mislead,\n\nor for second and subsequent offenses, the penalty shall be\n\nimprisonment for not more than one year, or a fine of not more than\n\nThree Thousand Dollars ($3,000.00), or both such imprisonment and\n\nfine.\n\n(b) No person shall be subject to the penalties of subsection\n\n(a) of this section (1) for having violated Section 1603(c), if the\n\nreceipt, delivery, or proffered delivery of the hazardous substance\n\nwas made in good faith, unless he refuses to furnish, on request of\n\nan officer or employee duly designated by the State Commissioner of\n\nHealth, the name and address of the person from whom he purchased or\n\nreceived such hazardous substance, and copies of all documents, if\n\nany there be, pertaining to the delivery of the hazardous substance\n\nto him; or (2) for having violated Section 1603(a), if he\n\nestablishes a guaranty or undertaking signed by, and containing the\n\nname and address of, the person residing in the United States from\n\nwhom he received in good faith the hazardous substance, to the\n\neffect that the hazardous substance is not in misbranded packages\n\nwithin the meaning of that term in this article; or (3) for having\n\nviolated subsection (a) or (c) of Section 1603 in respect of any\n\nhazardous substance shipped or delivered for shipment for export to\n\nany foreign country, in a package marked for export on the outside\n\nof the shipping container and labeled in accordance with the\n\nspecifications of the foreign purchaser and in accordance with the\n\nlaws of the foreign country, but, if such hazardous substance is\n\nsold or offered for sale in domestic commerce, this clause shall not\n\napply.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"5ef6cf9720258b0d9524149648eb583e98bb5b0bf5295709a05e7cd8741a0a73","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1603","next":"us-ok/okla.-stat.-tit.-63-63-1-1605"},"notice":"GroundRules: Original legal text.
