Stat. tit. 63, § 63-1-1701.1A","heading":"Violation of rules, regulations or standards -","body":"Orders - Penalties.\n\nA. In addition to any other remedies provided for by law, the\n\nDepartment, pursuant to rules and regulations, may issue a written\n\norder to any person whom the Department has reason to believe is\n\npresently in violation of any standards or rules promulgated by the\n\nState Board of Health and to whom the Department has served, no less\n\nthan fifteen (15) days previously, a written notice of violation of\n\nsuch standards or rules. The fifteen-day notice period may be\n\nreduced as, in the opinion of the Department, may be necessary to\n\nrender the order reasonably effectual.\n\nB. The written order may require compliance with such standards\n\nor rules immediately or within a specified time period or both. The\n\norder may also assess an administrative fine for each day or part of\n\na day that such person fails to comply with the order.\n\nC. Any order issued pursuant to this section shall state with\n\nspecificity the nature of the violation. Any penalty assessed in\n\nthe order shall not exceed Ten Thousand Dollars ($10,000.00) per day\n\nof noncompliance with the order. In assessing such a penalty, the\n\nDepartment shall consider the seriousness of the violation and any\n\nefforts to comply with applicable requirements.\n\nD. Any order issued pursuant to the provisions of this section\n\nshall become a final order unless, no later than fifteen (15) days\n\nafter the order is served, the person or persons named therein\n\nrequest an administrative hearing. Upon such request the Department\n\nshall promptly conduct the hearing. The Department shall dismiss\n\nsuch proceedings where compliance with the order is demonstrated. A\n\nfinal order following a hearing may assess an administrative fine of\n\nan amount based upon consideration of the evidence but not exceeding\n\nthe amount stated in the written order.\n\nE.
