Except as provided in subsection B of this section, in any\n\nmedical liability action in which the health care services at issue\n\nwere provided for:\n\n1. Pregnancy or labor and delivery, including the immediate\n\npost-partum period; or\n\n2. Emergency care in the emergency room of a hospital or as\n\nfollow-up to the emergency care services provided in the emergency\n\nroom;\n\nthe amount of noneconomic damages awarded shall not exceed Three\n\nHundred Thousand Dollars ($300,000.00), regardless of the number of\n\nparties against whom the action is brought or the number of actions\n\nbrought with respect to the personal injury.\n\nB. Where the judge finds by clear and convincing evidence that\n\nthe defendant committed negligence in one of the types of cases\n\nenumerated in subsection A of this section, the court shall\n\narticulate its findings into the record out of the presence of the\n\njury and shall lift the noneconomic damage cap.\n\nC. Nothing in this section shall apply to any nursing facility\n\nor nursing home licensed pursuant to Section 1-1903 of this title or\n\nthe owners, operators, officers, agents or employees of such\n\nentities.\n\nD. Nothing in this section shall apply to a medical liability\n\naction brought for wrongful death.\n\nE.
