Stat. tit. 63, § 63-1-1709","heading":"Information concerning condition and treatment of","body":"patients - Restrictions - Exemption from liability - Review\n\ncommittees.\n\nAny authorized person, hospital, sanatorium, nursing home or\n\nrest home, or other organization may provide information,\n\ninterviews, reports, statements, memoranda or other data relating to\n\nthe condition and treatment of any person to any of the following\n\nfor use in the course of studies for the purpose of reducing\n\nmorbidity or mortality: The State Board of Health; the Oklahoma\n\nState Medical Association, or any committee or allied society\n\nthereof; the American Medical Association, or other national\n\norganization approved by the State Board of Health, or any committee\n\nor allied medical society thereof; any in-hospital staff committee;\n\nor a city-county health department. No liability for damages or\n\nother relief shall arise or be enforced against any authorized\n\nperson, institution or organization by reason of having provided\n\nsuch information or material, or by reason of having released or\n\npublished the findings and conclusions of such groups to advance\n\nmedical research and medical education, or by reason of having\n\nreleased or published generally a summary of such studies. The\n\nrecipients shall use or publish such information or material only\n\nfor the purpose of advancing medical research or medical education\n\nin the interest of reducing morbidity or mortality, except that a\n\nsummary of such studies may be released by any such group for\n\ngeneral publication. In all events, the identity of any person\n\nwhose condition or treatment has been studied shall be confidential\n\nand shall not be revealed under any circumstances. Any information\n\nfurnished shall not contain the name of the person upon whom\n\ninformation is furnished and shall not violate the confidential\n\nrelationship of patient and doctor. All information, interviews,\n\nreports, statements, memoranda, or other data furnished by reason of\n\nthis section, and any findings or conclusions resulting from such\n\nstudies, are declared to be privileged communications which may not\n\nbe used or offered or received in evidence in any legal proceeding\n\nof any kind or character, and any attempt to use or offer any such\n\ninformation, interviews, reports, statements, memoranda or other\n\ndata, findings or conclusions, or any part thereof, unless waived by\n\nthe interested parties, shall constitute prejudicial error in any\n\nsuch proceeding. Physicians and others appointed to hospital\n\nutilization review committees for the purpose of determining the\n\noptimum use of hospital services shall be immune from liability with\n\nrespect to decisions made as to such utilization and actions\n\nthereunder so long as such physicians or others act in good faith;\n\nprovided, however, that nothing in this section shall be construed\n\nto relieve any patient's personal physician of any liability which\n\nhe may have in connection with the treatment of such patient.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"002f13197fc39eac76f5ea148789a3cff50bc630221facb6064ab57ae703cbc4","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1708.1i","next":"us-ok/okla.-stat.-tit.-63-63-1-1709.1"},"notice":"GroundRules: Original legal text.
