Stat. tit. 63, § 63-1-1904","heading":"Licensure and certification - Purpose - Procedure -","body":"Violations - Applications.\n\nA. The State Department of Health shall establish a\n\ncomprehensive system of licensure and certification for facilities\n\nin accordance with the Nursing Home Care Act for the purposes of:\n\n1. Protecting the health, welfare and safety of residents;\n\n2. Assuring the accountability for reimbursed care provided in\n\ncertified facilities participating in a federal or state health\n\nprogram as provided by or through the Oklahoma Health Care\n\nAuthority; and\n\n3. Assuring consistent application of uniform inspection\n\nprotocols.\n\nB. The licensing and certification procedures and standards\n\nprovided in this act, or by rules of the State Board of Health,\n\nshall be no less than provided in statute and rules currently\n\ngoverning nursing facilities.\n\nC. It shall be unlawful and upon conviction thereof, punishable\n\nas a misdemeanor for any person to operate, manage or open a\n\nfacility unless such operation and management shall have been\n\napproved and regularly licensed as hereinafter provided.\n\nD. Before an initial license shall be issued pursuant to the\n\nNursing Home Care Act to operate and manage a facility, the\n\napplicant shall provide the following:\n\n1. An application on a form provided by the Department\n\ncontaining, at a minimum, the following information:\n\na. the name and address of the applicant, if an\n\nindividual, and that the applicant is not less than\n\ntwenty-one (21) years of age, of reputable and\n\nresponsible character, and in sound physical and\n\nmental health; and if a firm, partnership, or\n\nassociation, of every member thereof; and in the case\n\nof a corporation, the name and address thereof and of\n\nits officers and its registered agent and like\n\nevidence for officers, as submitted for an individual,\n\nb. the name and location of the facility for which a\n\nlicense is sought,\n\nc. the name and address of the person or persons under\n\nwhose management or supervision the facility will be\n\nconducted, and a copy of the written agreement between\n\nthe manager and the applicant,\n\nd. the name and address of any other person holding an\n\ninterest of at least five percent (5%) in the\n\nownership, operation or management of the facility,\n\ne. the number and type of residents for which\n\nmaintenance, personal care, specialized or nursing\n\nfacility services are to be provided, and\n\nf. a projected staffing pattern for providing patient\n\ncare;\n\n2. A statement from the unit of local government having zoning\n\njurisdiction over the facility's location stating that the location\n\nof the facility is not in violation of a zoning ordinance; and\n\n3. Documentation that the administrator is the holder of a\n\ncurrent license as a Nursing Home Administrator issued by the\n\nOklahoma State Board of Examiners for Nursing Home Administrators.\n\nE. Before issuing an initial license, the Department shall find\n\nthat the individual applicant, or the corporation, partnership or\n\nother entity, if the applicant is not an individual, is a person\n\nresponsible and suitable to operate or to direct or participate in\n\nthe operation of a facility by virtue of financial capacity,\n\nappropriate business or professional experience, a record of\n\ncompliance with lawful orders of the Department and lack of\n\nrevocation of a license during the previous five (5) years. In\n\ndetermining the applicant's responsibility and suitability to\n\noperate or to direct or participate in the operation of a facility,\n\nthe Department may also consider the applicant's record of\n\nsuspensions, receivership, administrative penalties, or\n\nnoncompliance with lawful orders of this Department or of other\n\ndepartments of other states with similar responsibilities.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"170efee79fda7e4deb53c8bc53d2049227fba5f8411b3d289ac5b904468c1c84","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1903","next":"us-ok/okla.-stat.-tit.-63-63-1-1905"},"notice":"GroundRules: Original legal text.
