No facility shall be licensed to operate or continue to\n\noperate unless, in addition to compliance with other current\n\nlicensure requirements, the building is of one-hour fire resistant\n\nconstruction and approved by the Department and the State Fire\n\nMarshal. If the building is not of one-hour fire resistant\n\nconstruction in addition to the other current licensure\n\nrequirements, the facility must be approved by the State Department\n\nof Health and the State Fire Marshal. In addition, the facility\n\nmust have an approved automatic sprinkler system, as rated and\n\napproved by the National Fire Protection Association Standards.\n\nB. Each facility that proposes an increase in beds, whether\n\nthrough new construction or modification, shall submit construction\n\nplans to the Department for review prior to the start of\n\nconstruction. The Department may assess a fee for such review in an\n\namount not more than two one-hundredths percent (0.02%) or One\n\nThousand Dollars ($1,000.00), whichever is the least amount, per\n\nproject of the total construction cost of the facility or\n\nmodification. The maximum fee for plan review for a ten-bed or ten\n\npercent (10%) expansion project authorized under subsection C of\n\nSection 1-852 of this title shall be One Thousand Dollars\n\n($1,000.00). The State Board of Health shall promulgate rules for\n\nsubmission and resubmission of construction plans to ensure the\n\ntimely review of such plans by the Department.\n\nC. The Department of Human Services and the Oklahoma Health\n\nCare Authority shall not make a vendor payment to any individual or\n\nfacility on behalf of any person for medical care rendered in the\n\nform of nursing service outside such person's home, unless such\n\nindividual or facility holds a current nursing facility, continuum\n\nof care facility, assisted living, or adult day care license issued\n\nby the Commissioner or other state agency authorized to issue such\n\nlicense.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c1e84f64cbe1b0daae37c7bfd123a0b5d5d0c0acb343d2148bf99991f979a056","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1906","next":"us-ok/okla.-stat.-tit.-63-63-1-1908.1"},"notice":"GroundRules: Original legal text.
