Stat. tit. 63, § 63-1-1908.1","heading":"Funding source for temporary managers, state monitors","body":"or receivers – Nursing Facility Administrative Penalties Fund.\n\nA. The Oklahoma Health Care Authority shall amend the state\n\nMedicaid plan to provide a funding source for payment of temporary\n\nmanagers, state monitors or receivers in facilities certified to\n\nprovide long-term care services under Medicaid, upon request of the\n\nState Department of Health, pursuant to 42 U.S.C.A., Section\n\n1396r(h)(z).\n\nB. There is hereby created in the State Treasury a revolving\n\nfund for the State Department of Health to be designated the\n\n“Nursing Facility Administrative Penalties Fund”. The fund shall be\n\na continuing fund, not subject to fiscal year limitations, and shall\n\nconsist of all monies received by the State Department of Health\n\nfrom administrative penalties imposed under the Nursing Home Care\n\nAct. Monies collected as a result of administrative penalties\n\nimposed under the Nursing Home Care Act shall be deposited into the\n\nfund. All monies accruing to the credit of the fund are hereby\n\nappropriated and may be budgeted and expended by the Department for\n\nthe protection of health or property of residents of nursing and\n\nspecialized nursing facilities that have been placed under temporary\n\nmanagers, state monitors or receivers requested by the Department,\n\nincluding, but not limited to, the following purposes:\n\n1. Relocation expenses incurred by the Department, in the event\n\nof closure of a facility;\n\n2. Maintenance of facility operation pending correction of\n\ndeficiencies or closure, such as temporary management, state monitor\n\nor receivership, in the event that the revenues of the facility are\n\ninsufficient; or\n\n3.
