Stat. tit. 63, § 63-1-1914","heading":"Plan of correction of violations to be submitted -","body":"Report of correction - Petition for time extension - Contest of\n\ndepartment action.\n\nA. A facility shall have ten (10) working days after receipt of\n\nnotice of violation in which to prepare and submit a plan of\n\ncorrection. The plan of correction shall include a fixed time\n\nperiod, not to exceed sixty (60) days within which the violations\n\nare to be corrected. The Department may extend this period where\n\ncorrection involves substantial structural improvement. If the\n\nDepartment rejects a plan of correction, it shall send notice of the\n\nrejection and the reason for the rejection to the facility. The\n\nfacility shall have ten (10) working days after receipt of the\n\nnotice of rejection in which to submit a modified plan. If the\n\nmodified plan is not timely submitted, or if the modified plan is\n\nrejected, the Department shall impose a plan of correction which the\n\nfacility shall follow.\n\nB. If the violation has been corrected prior to submission and\n\napproval of a plan of correction, the facility may submit a report\n\nof correction in place of a plan of correction.\n\nC. Upon a licensee's written request, the Department shall\n\ndetermine whether to grant a licensee's request for an extended\n\ncorrection time. Such request shall be served on the Department\n\nprior to expiration of the correction time originally approved. The\n\nburden of proof shall be on the licensee to show good cause for not\n\nbeing able to comply with the original correction time approved.\n\nD.
