Upon receipt of a request for an alternative informal\n\ndispute resolution from a facility, the State Department of Health\n\nshall assign the matter to an impartial decision-making panel.\n\nB. The Department shall:\n\n1. Schedule a time and date for a meeting; and\n\n2. Inform the parties of the time and date of the alternative\n\ninformal dispute resolution.\n\nC. If the request for an alternative informal dispute\n\nresolution includes a request by the facility for a meeting at which\n\nthe facility may appear before the decision-making panel, the\n\nDepartment shall:\n\n1. Arrange for facilities appropriate for conducting the\n\nmeeting; and\n\n2. Inform the parties of the location of the meeting.\n\nD. Each party shall submit to the impartial decision-making\n\npanel all documentary evidence that the party believes has a bearing\n\non or relevance to the deficiencies in dispute by the date specified\n\nby the Department.\n\nE. 1. If the request for an alternative informal dispute\n\nresolution does not include a request by the facility for a meeting\n\nat which the facility may appear before the impartial decision-\n\nmaking panel, or upon agreement of the facility and the Department,\n\nthe impartial decision-making panel may conduct the meeting by\n\ntelephone conference call or by a review of documentary evidence\n\nsubmitted by the parties.\n\n2. a. If the alternative informal dispute resolution is\n\nconducted by record review, the impartial decision-\n\nmaking panel may request, and the facility shall\n\nprovide, a written statement setting forth the\n\nfacility’s position on accepting, rejecting, or\n\nmodifying each deficiency in dispute.\n\nb. The written statement shall specify the documentary\n\nevidence that supports the position of the facility\n\nfor each deficiency in dispute.\n\nc. The facility shall provide its written statement to\n\nthe impartial decision-making panel and the\n\nDepartment.\n\nd.
