In all alternative informal dispute resolution cases\n\nexcept record review, the State Department of Health shall present\n\nthe initial arguments.\n\n2. The facility shall then present its arguments.\n\nB. 1. The alternative informal dispute resolution shall be\n\nlimited to no more than two (2) hours in length, with each party\n\nbeing permitted one (1) hour to present its arguments;\n\n2. However, the impartial decision-making panel may grant each\n\nparty additional equal time for good cause as determined by the\n\nimpartial decision making-panel.\n\nC. 1. Rules of evidence or procedure shall not apply to the\n\nalternative informal dispute resolution except as provided in this\n\nsection.\n\n2. The impartial decision-making panel may:\n\na. accept any information that the impartial decision-\n\nmaking panel deems material to the issue being\n\npresented, and\n\nb. reject any information that the impartial decision-\n\nmaking panel deems immaterial to the issue being\n\npresented.\n\nD. 1. The alternative informal dispute resolution may not be\n\nrecorded.\n\n2. However, the impartial decision-making panel may make\n\nwritten or recorded notes of the arguments.\n\nE. Only employees of the facility, attending physicians of\n\nresidents of the facility at the time of the deficiency, pharmacists\n\nproviding medications to residents of the facility at the time of\n\nthe deficiency, and consultant pharmacists or nurse consultants\n\nutilized by the facility, or the medical director of the facility,\n\nmay appear or participate in the alternative informal dispute\n\nresolution for, or on the behalf of, the facility.\n\nF. Only employees of the Department may appear or participate\n\nat the meeting for, or on behalf of, the Department.\n\nG. The State Long-Term Care Ombudsman or designee, may appear\n\nat, or participate in, the meeting.\n\nH.
