Stat. tit. 63, § 63-1-1914.15","heading":"Alternative informal dispute resolution -","body":"Determinations - State survey agency determination - Amended\n\nstatement of deficiencies.\n\nA. 1. Upon the conclusion of all arguments by the parties at\n\nthe alternative informal dispute resolution, the impartial decision-\n\nmaking panel shall issue a written statement of findings that shall\n\nbe entitled “Determinations”.\n\n2. The determinations shall include:\n\na. a recitation of the deficiency identification numbers,\n\nb. a statement of whether a disputed deficiency should\n\nremain, be removed, or be modified on the statement of\n\ndeficiencies, and\n\nc. the facts and persuasive arguments that support the\n\nfinding of the impartial decision-making panel for\n\neach deficiency identification number.\n\nB. 1. The determination of the impartial decision-making panel\n\nshall be provided to all parties.\n\n2. The State Department of Health shall review the\n\ndetermination and shall issue a written document entitled “State\n\nSurvey Agency Determination”.\n\nC. A state survey agency determination is not subject to\n\nappeal, reargument, or reconsideration.\n\nD. The Department shall deliver a copy of the state survey\n\nagency determination to the facility and to the impartial decision-\n\nmaking panel.\n\nE. 1. In accordance with the state survey agency\n\ndetermination, the Department shall issue an amended state of\n\ndeficiencies if the state survey agency determination results in\n\nmodification to any deficiencies cited in the original statement of\n\ndeficiencies.\n\n2. If the Department determines that amendments to the\n\nstatement of deficiencies should result in changes to the scope or\n\nseverity assigned to any deficiency, the amended statement of\n\ndeficiencies shall reflect the changes to the scope or severity of\n\nany cited deficiency.\n\nF.
