Upon receipt of a request for an informal dispute resolution\n\nfrom a facility, the State Department of Health shall assign the\n\nmatter to an impartial decision maker.\n\nB. The impartial decision maker shall:\n\n1. Schedule a time and date for a meeting; and\n\n2. Inform the parties of the time and date of the informal\n\ndispute resolution.\n\nC. If the request for an informal dispute resolution includes a\n\nrequest by the facility for a meeting at which the facility may\n\nappear before the impartial decision maker, the impartial decision\n\nmaker shall:\n\n1. Arrange for facilities appropriate for conducting the\n\nmeeting; and\n\n2. Inform the parties of the location of the meeting.\n\nD. Each party shall submit to the impartial decision maker all\n\ndocumentary evidence that the party believes has a bearing on or\n\nrelevance to the deficiencies in dispute by the date specified by\n\nthe impartial decision maker.\n\nE. 1. If the request for an informal dispute resolution does\n\nnot include a request by the facility for a meeting at which the\n\nfacility may appear before the impartial decision maker, or upon\n\nagreement of the facility and the Department, the impartial decision\n\nmaker may conduct the meeting by telephone conference call or by a\n\nreview of documentary evidence submitted by the parties.\n\n2. a. If the informal dispute resolution is conducted by\n\nrecord review, the impartial decision maker may\n\nrequest, and the facility shall provide, a written\n\nstatement setting forth the facility’s position on\n\naccepting, rejecting, or modifying each deficiency in\n\ndispute.\n\nb. The written statement shall specify the documentary\n\nevidence that supports the position of the facility\n\nfor each deficiency in dispute.\n\nc. The facility shall provide its written statement to\n\nthe impartial decision maker and the Department.\n\nd.
