In all informal dispute resolution cases except record\n\nreview, the State Department of Health shall present the initial\n\narguments.\n\n2. The facility shall then present its arguments.\n\nB. 1. The informal dispute resolution shall be limited to no\n\nmore than two (2) hours in length, with each party being permitted\n\none (1) hour to present its arguments.\n\n2. However, the impartial decision maker may grant each party\n\nadditional equal time for good cause as determined by the impartial\n\ndecision maker.\n\nC. 1. Rules of evidence or procedure shall not apply to the\n\ninformal dispute resolution except as provided in this section.\n\n2. The impartial decision maker may:\n\na. accept any information that the impartial decision\n\nmaker deems material to the issue being presented, and\n\nb. reject any information that the impartial decision\n\nmaker deems immaterial to the issue being presented.\n\nD. 1. The informal dispute resolution may not be recorded.\n\n2. However, the impartial decision maker may make written or\n\nrecorded notes of the arguments.\n\nE. Only employees of the facility, attending physicians of\n\nresidents of the facility at the time of the deficiency, pharmacists\n\nproviding medications to residents of the facility at the time of\n\nthe deficiency, and consultant pharmacists or nurse consultants\n\nutilized by the facility, or the medical director of the facility\n\nmay appear or participate in the informal dispute resolution for, or\n\non the behalf of, the facility.\n\nF. Only employees of the Department may appear or participate\n\nat the meeting for, or on behalf of, the Department.\n\nG. The State Long-Term Care Ombudsman, or designee, may appear\n\nat, or participate in, the meeting.\n\nH.
