Any employee or agent of a public agency or any\n\nrepresentative of a community legal services program or any member\n\nof a nonprofit community supported agency which provides health or\n\nsocial services to the elderly, or any member of a church group,\n\nassociation of older persons or community service club which\n\nprovides volunteers for service to nursing home residents shall be\n\npermitted access at reasonable hours, which shall be 10:00 a.m. to\n\n8:00 p.m., to any individual resident of any facility, if the\n\npurpose of such agency, program or organization includes rendering\n\nassistance to residents without charge, but only if there is neither\n\na commercial purpose nor affect to such access and if the purpose is\n\nto do any of the following:\n\n1. Visit, talk with and make personal, social and legal\n\nservices available to all residents;\n\n2. Inform residents of their rights and entitlements and their\n\ncorresponding obligations, under federal and state laws, by means of\n\neducational materials and discussions in groups and with individual\n\nresidents;\n\n3. Assist residents in asserting their legal rights regarding\n\nclaims for public assistance, medical assistance and Social Security\n\nbenefits, as well as in all other matters in which residents are\n\naggrieved. Assistance may include counseling and litigation; or\n\n4. Engage in other methods of asserting, advising and\n\nrepresenting residents so as to extend to them full enjoyment of\n\ntheir rights.\n\nB. All persons entering a facility under this section shall\n\npromptly notify appropriate facility personnel of their presence.\n\nThey shall, upon request, produce identification to establish their\n\nidentity. No such person shall enter the immediate living area of\n\nany resident without first identifying himself and then receiving\n\npermission from the resident to enter. The rights of other\n\nresidents present in the room shall be respected. A resident may\n\nterminate at any time a visit by a person having access to the\n\nresident's living area under this section.\n\nC. This section shall not limit the power of the Department or\n\nother public agency otherwise permitted or required by law to enter\n\nand inspect a facility.\n\nD. Notwithstanding subsection A of this section, the\n\nadministrator of a facility may refuse access to the facility to any\n\nperson if the presence of that person in the facility would be\n\ninjurious to the health and safety of a resident or would threaten\n\nthe security of the property of a resident or the facility, or if\n\nthe person seeks access to the facility for commercial purposes. Any\n\nperson refused access to a facility may within ten (10) days request\n\na hearing. In that proceeding, the burden of proof as to the right\n\nof the facility to refuse access under this section shall be on the\n\nfacility.\n\nE.
