Stat. tit. 63, § 63-1-1920","heading":"Protection of resident's funds","body":"To protect each resident's funds, the facility or home:\n\n1. Shall reserve a portion of each resident's monthly income,\n\nin an amount not less than Twenty-five Dollars ($25.00), as a\n\npersonal needs allowance for use by the resident, or for use on\n\nbehalf of the resident by his guardian, or other representative\n\ndesignated by the resident;\n\n2. Shall at the time of admission, provide each resident, or\n\nhis representative, with a written statement explaining the\n\nresident's rights regarding personal funds and listing the services\n\nfor which the resident will be charged, and obtain a signed\n\nacknowledgment from each resident or his representative that he has\n\nreceived the statement;\n\n3. May accept funds from a resident for safekeeping and\n\nmanaging, if the facility or home receives written authorization\n\nfrom the resident or his guardian; such authorization shall be\n\nattested to by a witness who has no pecuniary interest in the\n\nfacility or home or its operations, and who is not connected in any\n\nway to facility or home personnel or the administrator in any manner\n\nwhatsoever;\n\n4. Shall maintain and allow each resident and responsible party\n\naccess to a written record of all financial arrangements and\n\ntransactions involving the individual resident's funds;\n\n5. Shall provide each resident, or his representative with a\n\nwritten itemized statement on request, of all financial transactions\n\ninvolving the resident's funds;\n\n6. Shall keep any funds received from a resident for\n\nsafekeeping in an account separate from the facility's or home's\n\nfunds and shall maintain such funds as required by the Department of\n\nHuman Services and federal regulations;\n\n7. Shall return to the resident, upon written request by the\n\nresident or his guardian, if court-appointed, all or any part of the\n\nresident's funds given the facility or home for safekeeping,\n\nincluding the interest accrued from deposits;\n\n8. Shall place any monthly allowance to which a resident is\n\nentitled in that resident's personal account, or give it to the\n\nresident, unless the facility or home has written authorization from\n\nthe resident or the resident's guardian or if the resident is a\n\nminor, his parent, to handle it differently;\n\n9. Unless otherwise provided by state law, upon the death of a\n\nresident, shall provide the administrator or executor of the\n\nresident's estate with a complete accounting of all the resident's\n\npersonal property, including any funds of the resident being held by\n\nthe facility or home; and\n\n10.
