A written contract shall be executed between a person or his\n\nguardian or responsible party or if the resident is a minor, his\n\nparent, and a facility or its agent within one hundred twenty (120)\n\ndays from the time a person is admitted to a facility, or at the\n\nexpiration of the period of previous contract, or when the source of\n\npayment for the resident's care changes from private to public funds\n\nor from public to private funds; if a person is a resident of a\n\nfacility on the effective date of this act and no legally\n\nenforceable contract exists, then a contract as described in this\n\nsection shall be executed within sixty (60) days after the effective\n\ndate of this act. If the facility receives or is to receive payment\n\nby the state or federal government, an individual contract with the\n\nnursing home is not required.\n\nA resident shall not be discharged or transferred at the\n\nexpiration of the term of a contract, except as provided in Sections\n\n1-1926 through 1-1937 of this title.\n\nB. The contract shall be executed between the resident or the\n\nresident's guardian or, if the resident is a minor, his parent or\n\nguardian and the licensee.\n\nC. A copy of the contract shall be given to the resident or to\n\nthe resident's representative at the time of the resident's\n\nadmission to the facility.\n\nD. A copy of the contract for a resident who is supported by\n\nnonpublic funds other than the resident's own funds shall be made\n\navailable to the person providing the funds for the resident's\n\nsupport.\n\nE. The contract shall be written in clear and unambiguous\n\nlanguage and shall be printed in type no smaller than standard\n\ntypewriter pica or elite type. The general form of the contract\n\nshall be prescribed by the Department.\n\nF. The contract shall specify:\n\n1. The term of the contract;\n\n2. The services to be provided under the contract and the\n\ncharges for the services;\n\n3. The services that may be provided to supplement the contract\n\nand the charges for the services;\n\n4. The sources liable for payments due under the contract;\n\n5. The amount of deposit paid; and\n\n6. The rights, duties and obligations of the resident, except\n\nthat the specification of a resident's rights may be furnished on a\n\nseparate document which complies with the requirements of Section 1-\n\n1918 of this title.\n\nG. The contract shall designate the name of the resident's\n\nrepresentative, if any.\n\nH. The contract shall provide that if the resident dies or is\n\ncompelled by a change in physical or mental health to leave the\n\nfacility, the contract and all obligations under it shall terminate\n\nimmediately. All charges shall be prorated as of the date on which\n\nthe contract terminates, and, if any payments have been made in\n\nadvance, the excess shall be refunded to the resident.
