There is hereby re-created, to continue until July 1, 2025,\n\nin accordance with the provisions of the Oklahoma Sunset Law, a\n\nLong-Term Care Facility Advisory Council which shall be composed as\n\nfollows:\n\n1. The Governor shall appoint a thirteen-member Long-Term Care\n\nFacility Advisory Council which shall advise the State Commissioner\n\nof Health. The Advisory Council shall be comprised of the following\n\npersons:\n\na. one representative from the Oklahoma Health Care\n\nAuthority, designated by the Administrator,\n\nb. one representative from the Department of Mental\n\nHealth and Substance Abuse Services, designated by the\n\nCommissioner of Mental Health and Substance Abuse\n\nServices,\n\nc. one representative from the Department of Human\n\nServices, designated by the Director of Human\n\nServices,\n\nd. one member who shall be a licensed general\n\npractitioner of the medical or osteopathic profession,\n\ne. one member who shall be a registered pharmacist,\n\nf. one member who shall be a licensed registered nurse or\n\nlicensed practical nurse,\n\ng. one member who shall be an operator-administrator of a\n\nnursing home which has a current license issued\n\npursuant to the Nursing Home Care Act and who shall\n\nhave had five (5) years’ experience in the nursing\n\nhome profession as an operator-administrator,\n\nh. one member who shall be an operator-administrator of a\n\nresidential care home licensed pursuant to the\n\nprovisions of the Residential Care Act,\n\ni. one member who shall be an owner-operator of an adult\n\nday care facility licensed pursuant to the provisions\n\nof the Adult Day Care Act,\n\nj. one member who shall be an owner-operator of a\n\ncontinuum of care facility or assisted living center\n\nlicensed pursuant to the provisions of the Continuum\n\nof Care and Assisted Living Act,\n\nk. two members who shall be over the age of sixty-five\n\n(65) who shall represent the general public and have\n\nno long-term care professional work history, and\n\nl. one member who shall be over the age of sixty-five\n\n(65) who shall represent the general public and who\n\nadvocates for individuals receiving long-term care\n\nservices; and\n\n2. Appointments shall be for two-year terms. Members shall\n\nserve at the pleasure of their designators. Members may be\n\nreappointed not to exceed two terms. In case of a vacancy, the\n\nGovernor shall appoint individuals to fill the remainder of the\n\nterm.\n\nB. The State Department of Health shall provide administrative\n\nsupport to perform designated duties of the Advisory Council. The\n\nDepartment shall also provide space for meetings of the Advisory\n\nCouncil.\n\nC. The Advisory Council shall annually elect a chair, vice-\n\nchair and secretary-treasurer, shall meet at least quarterly, and\n\nmay hold such special meetings as may be necessary. The members of\n\nthe Advisory Council shall be reimbursed as provided for by the\n\nState Travel Reimbursement Act.\n\nD. The Advisory Council shall have the power and duty to:\n\n1. Serve as an advisory body to the Department for the\n\ndevelopment and improvement of services to and care and treatment of\n\nresidents of facilities subject to the provisions of the Nursing\n\nHome Care Act, homes subject to the provisions of the Residential\n\nCare Act and facilities subject to the provisions of the Adult Day\n\nCare Act;\n\n2. Review and make recommendations regarding quality of\n\nservices, care, and treatment provided to individuals receiving\n\nservices from entities that are subject to the Nursing Home Care\n\nAct, the Residential Care Act and the Adult Day Care Act; and\n\n3.
