Stat. tit. 63, § 63-1-1930","heading":"Voluntary closing of facility - Notice - Alternative","body":"placement of residents - Relocation assistance.\n\nAny owner of a facility licensed under this act shall give\n\nninety (90) days' notice prior to voluntarily closing a facility or\n\nclosing any part of a facility, or prior to closing any part of a\n\nfacility if closing such part will require the transfer or discharge\n\nof more than ten percent (10%) of the residents. Such notice shall\n\nbe given to the Department, to any resident who must be transferred\n\nor discharged, to the resident's representative, and to a member of\n\nthe resident's family, where practicable. Notice shall state the\n\nproposed date of closing and the reason for closing. The facility\n\nshall offer to assist the resident in securing an alternative\n\nplacement and shall advise the resident on available alternatives.\n\nWhere the resident is unable to choose an alternative placement and\n\nis not under guardianship, the Department shall be notified of the\n\nneed for relocation assistance. The facility shall comply with all\n\napplicable laws and regulations until the date of closing, including\n\nthose related to transfer or discharge of residents. The Department\n\nmay place a relocation team in the facility if needed.
