The owner of a nursing facility shall notify the State\n\nDepartment of Health within twenty-four (24) hours of the occurrence\n\nof any of the events specified in subsection B of this section.\n\nSuch notification may be in written form. When initial notification\n\nto the Department is made by telephone or telephone facsimile, it\n\nshall be followed by a written confirmation within five (5) calendar\n\ndays.\n\nB. The occurrence of any of the following events shall require\n\nnotification pursuant to the provisions of subsection A of this\n\nsection:\n\n1. The owner of a facility receives notice that a judgment or\n\ntax lien has been levied against the facility or any of the assets\n\nof the facility or the licensee;\n\n2. A financial institution refuses to honor a check or other\n\ninstrument issued by the owner, operator or manager to its employees\n\nfor a regular payroll;\n\n3. The supplies, including food items and other perishables, on\n\nhand in the facility fall below the minimum specified in the Nursing\n\nHome Care Act or rules promulgated thereto by the State Board of\n\nHealth;\n\n4. The owner, operator or manager fails to make timely payment\n\nof any tax of any governmental agency;\n\n5. The filing of a bankruptcy petition under Title 7 or Title\n\n11 of the United States Code or any other laws of the United States,\n\nby any person or entity with a controlling interest in the facility;\n\n6. The appointment of a trustee by the bankruptcy court; and\n\n7.
