Stat. tit. 63, § 63-1-1930.3","heading":"Powers and duties of receiver – Liability - Limited","body":"duration license.\n\nA. The court may appoint any qualified person as a receiver,\n\nexcept it shall not appoint any owner or affiliate of the facility\n\nwhich is in receivership as its receiver. The State Department of\n\nHealth shall maintain a list of such persons to operate facilities\n\nwhich the court may consider.\n\nB. The receiver shall make provisions for the continued health,\n\nsafety and welfare of all residents of the facility.\n\nC. A receiver appointed under this section shall exercise those\n\npowers and shall perform those duties set out by the court. These\n\npowers and duties may include those generally ascribed to receivers\n\nand receiverships and may also include the powers and duties of\n\ntrustees under the 1978 Bankruptcy Code. The court shall provide\n\nfor the receiver to have sufficient power and duties to ensure that\n\nthe residents receive adequate care.\n\nD. All funds due to the facility from any source during the\n\npendency of the receivership shall be made available to the receiver\n\nwho shall use the funds to assure the health and safety of the\n\nfacility’s residents.\n\nE. A receiver may be held liable in a personal capacity only\n\nfor the receiver’s own gross negligence, intentional acts or\n\nbreaches of fiduciary duty.\n\nF.
