The court may terminate a receivership:\n\n1. If the time period specified in the order appointing the\n\nreceiver elapses and is not extended;\n\n2. If the court determines that the receivership is no longer\n\nnecessary because the conditions which gave rise to the receivership\n\nno longer exist or the State Department of Health grants the\n\nfacility a new license; or\n\n3. If all of the residents in the facility have been\n\ntransferred or discharged.\n\nB. 1. Within thirty (30) days after termination, the receiver\n\nshall give the court a complete accounting of all property of which\n\nthe receiver has taken possession, of all funds collected, and of\n\nthe expenses of the receivership.\n\n2. If the operating funds exceed the reasonable expenses of the\n\nreceivership, the court shall order payment of the surplus to the\n\nowner. If the operating funds are insufficient to cover the\n\nreasonable expenses of the receivership, the owner shall be liable\n\nfor the deficiency.\n\n3. The Department shall have a lien for any payment made to the\n\nreceiver upon any beneficial interest, direct or indirect, of any\n\nowner in the following property:\n\na. the building in which the facility is located,\n\nb. any fixtures, equipment or goods used in the operation\n\nof the facility,\n\nc. the land on which the facility is located, or\n\nd. the proceeds from any conveyance of property described\n\nin subparagraph a, b or c of this paragraph, made by\n\nthe owner within one (1) year prior to the filing of\n\nthe petition for receivership.\n\n4.
