Stat. tit. 63, § 63-1-1945","heading":"Definitions","body":"For purposes of the Long-term Care Security Act:\n\n1. “Long-term care facility” means:\n\na. a nursing facility or specialized facility as defined\n\nby Section 1-1902 of this title,\n\nb. an adult day care center as defined by Section 1-872\n\nof this title,\n\nc. skilled nursing care provided in a distinct part of a\n\nhospital as defined by Section 1-701 of this title,\n\nd. an assisted living center as defined by Section 1-\n\n890.2 of this title,\n\ne. the nursing care component of a continuum of care\n\nfacility as defined under the Continuum of Care and\n\nAssisted Living Act,\n\nf. the nursing care component of a life care community as\n\ndefined by the Long-term Care Insurance Act, or\n\ng. a residential care home as defined by Section 1-820 of\n\nthis title;\n\n2. “Ombudsman” means the individual employed by the Office of\n\nthe Attorney General as the State Long-Term Care Ombudsman;\n\n3. “Nurse aide” means any person who provides, for\n\ncompensation, nursing care or health-related services to residents\n\nin a nursing facility, a specialized facility, a residential care\n\nhome, continuum of care facility, assisted living center, or an\n\nadult day care center and who is not a licensed health professional.\n\nSuch term also means any person who provides such services to\n\nindividuals in their own homes as an employee or contract provider\n\nof a home health or home care agency, or as a contract provider of\n\nthe State Plan Personal Care Program of the state Medicaid program;\n\n4. “Employer” means any of the following facilities, homes,\n\nagencies, or programs which are subject to the provisions of Section\n\n1-1947 of this title:\n\na. a nursing facility or specialized facility as such\n\nterms are defined in the Nursing Home Care Act,\n\nb. a residential care home as such term is defined by the\n\nResidential Care Act,\n\nc. an adult day care center as such term is defined in\n\nthe Adult Day Care Act,\n\nd. an assisted living center as such term is defined by\n\nthe Continuum of Care and Assisted Living Act,\n\ne. a continuum of care facility as such term is defined\n\nby the Continuum of Care and Assisted Living Act,\n\nf. a home health or home care agency,\n\ng. the Department of Human Services, in its capacity as\n\nan operator of any hospital or health care institution\n\nor as a contractor with providers under the State Plan\n\nPersonal Care Program of the state Medicaid program,\n\nh. a hospice agency as such term is defined in the\n\nOklahoma Hospice Licensing Act,\n\ni. a Medicaid home- and community-based services waivered\n\nprovider as defined in Section 1915(c) or 1915(i) of\n\nthe federal Social Security Act,\n\nj. a staffing agency with a contracted relationship to\n\nprovide staff with direct patient access to service\n\nrecipients of one or more of the other employers\n\nlisted in this paragraph, and\n\nk. an independent contractor where the independent\n\ncontractor has a contracted relationship to provide\n\nstaff or services with direct patient access to\n\nservice recipients for one or more of the employers\n\nlisted in this paragraph;\n\n5. “Home health or home care agency” means any person,\n\npartnership, association, corporation, or other organization which\n\nadministers, offers, or provides health care services or supportive\n\nassistance for compensation to three or more ill, disabled, or\n\ninfirm persons in the temporary or permanent residence of such\n\npersons, and includes any subunits or branch offices of a parent\n\nhome health or home care agency;\n\n6. “Bureau” means the Oklahoma State Bureau of Investigation;\n\n7. “FBI” means the Federal Bureau of Investigation;\n\n8. “Applicant” means an individual who applies for employment\n\nwith an employer, applies to work as an independent contractor to an\n\nemployer, applies to provide services to service recipients through\n\nthe granting of clinical privileges by an employer, or applies to a\n\nnurse aide scholarship program;\nthe Oklahoma State Bureau of Investigation;\n\n7. “FBI” means the Federal Bureau of Investigation;\n\n8. “Applicant” means an individual who applies for employment\n\nwith an employer, applies to work as an independent contractor to an\n\nemployer, applies to provide services to service recipients through\n\nthe granting of clinical privileges by an employer, or applies to a\n\nnurse aide scholarship program;\n\n9. “Direct patient access” means access to a service recipient\n\nof an employer, through employment, independent contract, or the\n\ngranting of clinical privileges, in which the performance of duties\n\ninvolves, or may involve one-on-one contact with a service recipient\n\nof the employer on an ongoing basis. The term shall include access\n\nto a service recipient's property, medical information, or financial\n\ninformation. The term does not include a volunteer unless the\n\nvolunteer has duties that are equivalent to the duties of a direct\n\npatient access employee and those duties involve one-on-one contact\n\nwith a service recipient of an employer, without line-of-sight\n\nsupervision by employer staff;\n\n10. “Independent contract” means a contract entered into by an\n\nemployer with an individual who provides the contracted services\n\nindependently or a contract entered into by an employer with an\n\norganization or agency that employs or contracts with an individual\n\nafter complying with the requirements of this section to provide the\n\ncontracted services to the employer on behalf of the organization or\n\nagency;\n\n11. “Medicare” means benefits under the Federal Medicare\n\nProgram established under Title XVIII of the Social Security Act,\n\nTitle 42 of the United States Code, Sections 1395 to 1395hhh;\n\n12. “Registry screening” means a review of those registries\n\nidentified in subsection D of Section 1-1947 of this title;\n\n13. “Department” means the State Department of Health;\n\n14. “Nurse aide scholarship program” means a nurse aide\n\ntraining program operated under contract with the Oklahoma Health\n\nCare Authority for the purpose of providing free training to\n\nprospective nurse aides in exchange for employment in a SoonerCare\n\ncontracted facility; and\n\n15. “Service recipient” means a patient, resident, participant,\n\nconsumer, client, or member receiving services from an employer.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"c488f272a8885f1b26e60738bde2e43d89021f17fe7f94893c2b5232c94ef46b","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1944","next":"us-ok/okla.-stat.-tit.-63-63-1-1946"},"notice":"GroundRules: Original legal text.
