Stat. tit. 63, § 63-1-1950.5","heading":"Caregiver - Solicitation or acceptance of gifts -","body":"Offense.\n\nA. 1. It shall be unlawful for a caregiver to solicit or\n\naccept anything of value greater than One Dollar ($1.00) from any\n\nperson in the caregiver’s care; provided, however, nothing in this\n\nsection shall be construed as prohibiting a group of individuals,\n\nincluding family members and friends of residents, from establishing\n\nan employee recognition program consisting of voluntary, anonymous\n\nand confidential donations to care providers; provided further, no\n\ncare provider shall be included in the group making decisions\n\nregarding the disbursement. Such donations may be disbursed\n\npursuant to procedures established by the group.\n\n2. As used in this section, “caregiver” means a person who is:\n\na. the paid agent or employee of:\n\n(1) an assisted living center,\n\n(2) a nursing facility, specialized facility, or\n\nresidential care home as such terms are defined\n\nin Section 1-1902 of this title,\n\n(3) an adult day care center as such term is defined\n\nin Section 1-872 of this title,\n\n(4) a home health or home care agency, or\n\n(5) the Department of Human Services, in its capacity\n\nas an operator of any hospital or health care\n\ninstitution, or as a contractor with providers\n\nunder the Personal Care Services Program, or\n\nb. a personal care attendant hired by a consumer under\n\nthe Oklahoma Consumer-Directed Personal Assistance and\n\nSupport Services (Oklahoma CD-PASS) Program.\n\n“Caregiver” does not include a guardian, limited guardian, or\n\nconservator as such terms are defined in the Oklahoma Guardianship\n\nand Conservatorship Act.\n\nB.
