The State Department of Health shall establish a registry\n\nfor those nontechnical services workers that have been noted to have\n\ncommitted abuse, verbal abuse, or exploitation of a resident in a\n\nnursing facility.\n\nB. The State Board of Health shall promulgate rules to\n\nestablish and maintain the nontechnical services worker abuse\n\nregistry. Such rules may include, but need not be limited to:\n\n1. A procedure for notation in the abuse registry of a final\n\nState Department of Health investigative finding or an\n\nAdministrative Law Judge finding of abuse, verbal abuse, or\n\nexploitation, as these terms are defined in Section 10-103 of Title\n\n43A of the Oklahoma Statutes, of an individual by a nontechnical\n\nservices worker;\n\n2. A procedure for notice and due process for a nontechnical\n\nservices worker or applicant before the entering of such person's\n\nname in the abuse registry as having a final Department\n\ninvestigative finding or Administrative Law Judge finding of abuse,\n\nverbal abuse, or exploitation of an individual; and\n\n3. Disclosure requirements for information in the abuse\n\nregistry.\n\nC. The nontechnical services worker abuse registry shall\n\ninclude, but not be limited to, the following information on each\n\nnontechnical services worker:\n\n1. The individual's full name;\n\n2. Information necessary to identify each individual;\n\n3. The date the individual's name was placed in the abuse\n\nregistry; and\n\n4. Information on any final Department investigative finding or\n\nAdministrative Law Judge finding of abuse, verbal abuse or\n\nexploitation, as these terms are defined in Section 10-103 of Title\n\n43A of the Oklahoma Statutes, concerning the nontechnical services\n\nworker.\n\nD. A nontechnical services worker or applicant who is adversely\n\naffected by an Administrative Law Judge finding of abuse, verbal\n\nabuse or exploitation of an individual may seek judicial review\n\npursuant to the provisions of Article II of the Administrative\n\nProcedures Act. The finding of the Administrative Law Judge may be\n\nappealed to the district court in which the nontechnical services\n\nworker or applicant resides within thirty (30) days of the date of\n\nthe decision.
