Stat. tit. 63, § 63-1-1955.3","heading":"Oklahoma Long-Term Care Partnership Program -","body":"Purposes - Exhaustion of benefits - Asset disregard.\n\nA. Upon repeal of the restrictions to asset protection\n\ncontained in the Omnibus Budget Reconciliation Act of 1993, Public\n\nLaw 103-66, 107 Stat. 312, there shall be established the Oklahoma\n\nLong-Term Care Partnership Program, to be administered by the\n\nOklahoma Health Care Authority, with the assistance of the Insurance\n\nDepartment, to do the following:\n\n1. Provide incentives for individuals to insure against the\n\ncosts of providing for their long-term care needs;\n\n2. Provide a mechanism for individuals to qualify for coverage\n\nof the cost of their long-term care needs under the state Medicaid\n\nprogram without first being required to substantially exhaust their\n\nresources;\n\n3. Provide counseling services to individuals in planning for\n\ntheir long-term care needs; and\n\n4. Alleviate the financial burden on the state’s Medicaid\n\nprogram by encouraging the pursuit of private initiatives.\n\nB. Upon exhaustion of benefits under a Long-Term Care\n\nPartnership Program policy, certain resources of an individual, as\n\ndescribed in subsection C of this section, shall not be considered\n\nby the Authority when determining any of the following:\n\n1. Medicaid eligibility;\n\n2. The amount of any Medicaid payment; and\n\n3. Any subsequent recovery by the state of a payment for\n\nmedical services.\n\nC. The Oklahoma Health Care Authority shall amend the state\n\nMedicaid program to allow for asset disregard. The Authority shall\n\nprovide for asset disregard by counting insurance benefits paid\n\nunder a policy toward asset disregard to the extent the payments are\n\nfor covered services under the Oklahoma Long-Term Care Partnership\n\nProgram for purchasers of an Oklahoma Long-Term Care Partnership\n\nProgram approved policy.","path":["OK Code","Title 63"],"source_url":"https://www.oklegislature.gov/OK_Statutes/CompleteTitles/os63.pdf","current_through":"2026-08-14","vintage":"open-us-law v2026.08, retrieved 2026-09-14","retrieved_at":"2026-09-14T18:32:36Z","sha256":"a9d9e8dc18f617163c6fe6db22e7fdabfb21e36b728b0346d5ffc6fd8bce9e23","source_id":"us-ok","stale":false,"prev":"us-ok/okla.-stat.-tit.-63-63-1-1955.2","next":"us-ok/okla.-stat.-tit.-63-63-1-1955.4"},"notice":"GroundRules: Original legal text.
