A resident or representative of a resident who wishes to\n\nconduct authorized electronic monitoring shall be required to notify\n\nthe nursing facility, assisted living center or continuum of care\n\nfacility on the consent form prescribed by the State Department of\n\nHealth.\n\nB. The consent form prescribed by the Department shall require\n\nthe resident or the representative of a resident to obtain the\n\nconsent of any other resident in the room or the representative of a\n\nresident, using the consent form prescribed for this purpose by the\n\nDepartment, if the resident resides in a room with another resident.\n\nC. Consent may be given only:\n\n1. By the resident or any other resident in the room; or\n\n2. By the representative of the resident or representative of\n\nany other resident in the room.\n\nD. Another resident in the room may:\n\n1. When the proposed electronic monitoring device is a video\n\nsurveillance camera, condition consent on the camera being pointed\n\naway from the consenting resident; and\n\n2. Condition consent on the use of an audio electronic\n\nmonitoring device being limited or prohibited.\n\nE. Except as provided for in Section 1-1953.7 of this title,\n\nauthorized electronic monitoring may begin only after the required\n\nconsent forms specified in Section 1-1953.1 et seq. of this title\n\nhave been completed and returned to the nursing facility, assisted\n\nliving center or continuum of care facility and placed on file with\n\nthe administrator of such facility or center.\n\nF. If authorized electronic monitoring is being conducted in\n\nthe room of a resident, another resident may not be moved into the\n\nroom unless the resident or representative of the resident has\n\nconsented to the use of existing electronic monitoring, in\n\naccordance with Section 1-1953.1 et seq. of this title.\n\nG. The Department may include other information that it\n\nconsiders to be appropriate on any form it is required to prescribe\n\nunder the provisions of Section 1-1953.1 et seq. of this title.\n\nH.
